Damages – for breach of agreement governing eviction of settlers – damages for pain and suffering – damages for loss and destruction of property – apportionment of damages between defendants.


1,281 plaintiffs, illegal settlers on Government land, succeeded at a trial in establishing a cause of action in breach of the agreement governing their eviction against three defendants. A separate trial was conducted on assessment of damages. The plaintiffs claimed two categories of damages: (1) general damages for breach of agreement and pain and suffering, K5,000.00 each, a sum of K6,405,000.00; and (2) specific damages for destruction of property, different amounts being sought by each plaintiff, a sum of K13,585,763.81 (being 50% of the total amount claimed in the plaintiffs' evidence). The total amount of damages sought by all plaintiffs was K19,990,763.81. The Solicitor-General who appeared for the first defendant, the officer in charge of the police operation that involved forced eviction of the plaintiffs and destruction of their properties, and the third defendant, the State, argued that the first and third defendants should be excluded from the order to pay damages as they were not culpable for breach of the agreement, which was entirely the responsibility of the second defendant, the provincial government that was party to the agreement with the plaintiffs. The second defendant disagreed with the other defendants on the issue of apportionment of damages but all defendants agreed that any damages awarded to the plaintiffs should be nominal or negligible in view of the plaintiffs' failure to prove that they were genuine settlers or provide credible and corroborated evidence of the extent of their property damage.


Held


(1) If a judgment imposes liability on two or more defendants generally without apportioning liability amongst them the presumption arises that all defendants are jointly and severally liable for damages and for satisfaction of the judgment debt after assessment of damages.

(2) Here there was nothing in the judgment on liability or in the circumstances of the case to defeat the presumption as to joint and several liability of the defendants for payment of damages so the first and third defendants are not excluded from the order for damages.

(3) There was no evidence in support of the plaintiffs' claim for general damages and nothing was awarded for that category of damages.

(4) As for the claims for property damage the evidence was insufficient to fully support the claims, which suffered from a lack of corroboration, but the plaintiffs proved that they incurred some losses and destruction of their properties. Each claim pleaded in the statement of claim was discounted by 90% to arrive at an award of damages for property losses. Each claimant was awarded interest on the amount of general damages, calculated at the rate of 8% per annum from the date of service of the writ to the date of judgment, a period of 6.54 years.

(5) Total damages awarded was K2,717,152.76; total interest awarded was K1,412,919.44; the total judgment sum being K4,130,072.20.

1. CANNINGS J: This is an assessment of damages after liability has been established against three defendants in favour of 1,281 plaintiffs. The plaintiffs are individual citizens who had illegally settled on Government land in Madang town. They were affected by an eviction exercise in December 2003. Police squads led by the first defendant Inspector Tony Wagambie Jnr entered the settlements in which they were living and forcefully removed them and in the process destroyed their property including houses and other buildings and their contents and gardens and crops. The plaintiffs sued Inspector Wagambie and the second defendant Madang Provincial Government and the third defendant the State, claiming damages for the allegedly unlawful actions of the police. A trial was conducted on the question of liability. The court found that involvement of the police in the forced eviction exercise was unlawful. It was contrary to an agreement between the Provincial Government and the Madang Settlement Committee (which represented the plaintiffs and other illegal settlers) that was entered into in May 2000 and sanctioned by an order of the National Court in July 2000 (Francis Fuliva v Inspector Tony Wagambie, Madang Provincial Government and the State (2011) N4397). The agreement was also breached in other respects: there was a failure to identify and verify genuine settlers, a failure to resettle genuine settlers and a failure to allow for dialogue between the Provincial Government and the settlers. The trial on liability was concluded by an order that relevantly stated:


(1) It is declared that the plaintiffs have established a cause of action in breach of agreement against the defendants.

(2) The proceedings shall proceed, unless the parties agree on an alternative course of action or the court orders otherwise, to a trial on assessment of damages.

2. No alternative course of action has been agreed on so a trial on assessment of damages was conducted.


EVIDENCE


3. Most of the plaintiffs or their personal representatives (in the case of 53 plaintiffs who have died since commencement of proceedings in 2006) swore an affidavit giving details of the settlement in which they lived and the property that they claim was destroyed and its value. All affidavits were admitted into evidence without objection and constituted the plaintiffs' case. An affidavit by Peter Torot, Co-ordinator Field Services for Madang Provincial Government, deposing to the circumstances in which the eviction exercise was carried out was admitted into evidence without objection. It constituted the defendants' case. There was no oral testimony for the plaintiffs or the defendants.


SUBMISSIONS


4. The plaintiffs' counsel Mr Meten submitted that the plaintiffs should be awarded two categories of damages:


(1) general damages for breach of agreement and pain and suffering, K5,000.00 each, a total sum of K6,405,000.00; and


(2) specific damages for destruction of property, different amounts being sought by each plaintiff, a total sum of K13,585,763.81, being 50% of the total amount claimed in the plaintiffs' evidence (note that the actual figure quoted by Mr Meten was K12,401,282.50, which was 50% of the total amount claimed in the statement of claim, however the total amount claimed through the plaintiffs' evidence (K27,171,527.62) exceeded the total amount claimed in the statement of claim (K24,802,565.00).


The total amount of damages sought by all plaintiffs is K19,990,763.81. They also claim interest.


5. Mr Kelly and Mr Phannaphen of the Office of the Solicitor-General submitted on behalf of Inspector Wagambie and the State that their clients should be excluded from any order to pay damages as neither Insp Wagambie nor the State was responsible for breaching the agreement, which was entirely the responsibility of Madang Provincial Government. Mr Haumu for Madang Provincial Government disagreed with the other defendants on the issue of apportionment of damages but all defendants agreed that any damages awarded to the plaintiffs should be nominal or negligible in view of the plaintiffs' failure to prove that they were genuine settlers; or provide credible and corroborated evidence of the extent of their property damage.


ISSUES


6. There are four main issues:


  1. How should responsibility for payment of damages be apportioned?
  2. What is the assessment of damages for general damages and pain and suffering?
  3. What is the assessment of damages for destruction of property?
  4. Should the plaintiffs be awarded interest?

1 HOW SHOULD RESPONSIBILITY FOR PAYMENT OF DAMAGES BE APPORTIONED?


7. The first and third defendants argue that they should be excluded from any order to pay damages as they were not parties to the agreement the breach of which gave rise to the cause of action on which damages are being assessed. They were not the ones who breached the agreement. That was Madang Provincial Government. No damage was caused by any breach of the agreement by them. All responsibility for payment of damages should be sheeted home to Madang Provincial Government as it was the entity that entered into the agreement with the Madang Settlement Committee and gave instructions to the Police to conduct the eviction exercise. It would accord with principles of good governance and be a good accountability exercise to make the Provincial Government responsible for its own wrongs rather than allowing it to deflect responsibility to the State. Applying the 'but for' test of causation it is obvious that but for the direction of Madang Provincial Government to the Police to conduct the eviction exercise, it would not have occurred. The Police had no role to play in the agreement and were not a party to it. The determination of who was or was not a genuine settler was nothing to do with the Police. The provision of land for resettlement was nothing to do with the police. The conduct of a dialogue with the settlers about the issues covered by the agreement was also solely a matter for Madang Provincial Government. The court should invoke Section 37(2)(c) of the Wrongs (Miscellaneous Provisions) Act (Chapter 297) in accordance with a 'notice claiming contribution' filed in these proceedings on 7 February 2013 and apportion all responsibility for payment of damages to Madang Provincial Government. Section 37(2)(c) states:


Where damage is suffered by a person as a result of a tort (whether it is also an offence or not) ... a tortfeasor liable in respect of the damage may recover contribution from any other tortfeasor who is, or would if sued have been, liable in respect of the same damage (whether as a joint tortfeasor or otherwise), but no person is entitled to recover contribution under this section from a person entitled to be indemnified by him in respect of the liability in respect of which the contribution is sought.


8. I reject those arguments for several reasons. The judgment on liability delivered on 23 September 2011 was a final decision that resolved all questions of liability between the parties including the question of apportionment of liability amongst the defendants. If a judgment is signed against two or more defendants generally for the same cause of action without apportioning liability amongst them the presumption arises that all defendants are jointly and severally liable for damages and for satisfaction of the judgment debt after assessment of damages (London Association for the Protection of Trade v Greenlands Ltd [1916] 2 AC 15). The plaintiff is awarded the entire damages against each defendant. The plaintiff can pursue satisfaction of the entire judgment against one or more of the defendants provided not more than the total judgment is recovered.


9. A court order is, of course, open to interpretation. It is permissible when interpreting it to consider the reasons provided by the court for making the order and the circumstances in which it was made (Paias Wingti v Kala Rawali (2010) N3982, Tzen Pacific Ltd v Kanawi Pouru (2013) N5156). In this case the order is clear and unambiguous: the plaintiffs established a cause of action against "the defendants". The presumption arises that the three defendants are jointly and severally liable for damages. There is nothing in the judgment on liability or the circumstances of the case that defeats that presumption. If I were to uphold the arguments of the first and third defendants I would be altering the order of 11 September 2011 in a material way, which is not permitted except in the limited circumstances that would allow a slip rule application to be made (Richard Dennis Wallbank & Jeannette Minife v The State [1994] PNGLR 78, Trawen v Kama and Laimo (2010) SC1063). The first and third defendants have not filed a slip rule application. They have not applied in any proper way to have the judgment on liability set aside. They have not appealed to the Supreme Court against the judgment. They are therefore bound by it.


10. The arguments now raised by the first and third defendants were not raised in the trial on liability and that is another reason they do not deserve further consideration. If, however, they were to be considered on their merits I would not uphold them. Section 37(2)(c) of the Wrongs (Miscellaneous Provisions) Act is not relevant as it falls within Part VIII of the Act (tortfeasors) and only applies to contributions between tortfeasors: persons who have committed a tort. None of the defendants were found to have committed a tort as liability was found to have been established for breach of an agreement. Further the court did not find in the judgment on liability that Insp Wagambie and the Police acted only on the directions of Madang Provincial Government. The actions of Insp Wagambie and the Police were unlawful (whether they acted on directions or independently) as they were in breach of the order of the National Court of 28 July 2000 that stated that the agreement between Madang Settlement Committee and Madang Provincial Government was "sanctioned as an order of this Court to govern the eviction of illegal squatters from the Town of Madang". The third defendant, the State, is vicariously liable for the actions of Insp Wagambie and the police.


11. I confirm that the three defendants are jointly and severally liable for payment of damages to the plaintiffs.


2 WHAT IS THE ASSESSMENT OF GENERAL DAMAGES FOR PAIN AND SUFFERING?


12. In support of the submission that each plaintiff should be awarded K5,000.00 general damages Mr Meten pointed out that in addition to the specific claims for destruction of property the statement of claim (endorsed on the writ of summons by which these proceedings were commenced in 2006) pleaded two categories of damages described as 'damages for breach of the memorandum of agreement' and 'damages for pain and suffering'. Those two categories have been combined for the purposes of submissions. They are a claim for compensation for pain, suffering and loss of amenities as a result of the unlawful actions of the defendants. Mr Meten relied in particular on paragraph 19 of the statement of claim which alleges that "as a result of the plaintiffs' houses and properties being destroyed, all the plaintiffs had to sleep without shelter or little shelter in the wet and cold night for the remaining dates of the eviction exercise".


13. I find that these claims are vague and poorly defined and there is no evidence to support them. All of the plaintiffs give evidence of destruction of their property and its value but give no evidence of the personal pain or suffering that they endured. A pleading such as that in paragraph 19 of the statement of claim is not evidence. I reject all these claims and award nothing for general damages for pain and suffering.


3 WHAT IS THE ASSESSMENT OF DAMAGES FOR DESTRUCTION OF PROPERTY?


14. The eviction exercise that affected the plaintiffs in Madang in December 2003 was unlawful as it was carried out in breach of the agreement and the order of the National Court by which it was governed. Homes and other properties of the plaintiffs were destroyed. Of that there is no doubt. But, can it be said that each of the plaintiffs lost property? Can it be accepted that each of them lost the property that they say they lost? How can the value of that property be assessed? In answering those questions, I take into account the following principles for assessment of damages:


15. Mr Kelly and Mr Phannaphen submit that if those principles are applied to this case the plaintiffs should be awarded nothing as they have not proven any damages. None has proven that he or she was a genuine settler. If the court rejects that submission and proceeds to assess damages the claims should be discounted by at least 95% as they are vague, unsubstantiated and uncorroborated. As for the deceased plaintiffs all claims on their behalf should be struck out. Mr Haumu supported those submissions.


'Genuine settlers' argument


16. In the judgment on liability I upheld the plaintiffs' argument that Madang Provincial Government breached the agreement by not identifying and verifying the genuine settlers before engaging the Police to effect forced evictions. The Provincial Government also failed to resettle genuine settlers in Madang town before the eviction exercise was undertaken. The defendants now argue that for purposes of assessment of damages the distinction between genuine and non-genuine settlers is critical as only genuine settlers incurred any significant losses as a result of the eviction exercise. The non-genuine settlers were going to be evicted anyway under the terms of the agreement as they were residing on land on which they were not legally entitled to reside. Accordingly the only damages that can be awarded to non-genuine settlers are damages suffered because they were evicted sooner than they might have been, had the terms of the agreement been applied.


17. I find this argument to be misconceived. The plaintiffs are entitled to compensation for the damage to their property caused by the unlawful actions of the defendants, manifested by the police moving into settlements and forcefully evicting people from their homes and destroying their property. They are not being compensated merely for the inconvenience and losses caused by being evicted sooner than was agreed. If the eviction exercise had been conducted in accordance with the agreement, genuine settlers would have been identified and resettled in Madang town and non-genuine settlers would have had the opportunity to preserve or dismantle their property to take it with them when they left the land on which they had resided. All of this would have been done in a peaceful and orderly way. If the agreement had been complied with the plaintiffs' property would not have been unlawfully destroyed. The failure of the plaintiffs to prove that they were genuine settlers has no bearing on their entitlement to damages.


Lack of corroboration argument


18. I find this argument persuasive. There is no evidence to corroborate any of the plaintiffs' claims. The greatest deficiency in the plaintiffs' case is that there is no independent corroboration of the details of the incident and the extent of each plaintiff's losses. If there had been an investigation of the incident soon after it occurred by an independent body such as the Ombudsman Commission it would be easier to accept the claims at face value. Some independent person or agency should have been involved and taken down the names of everyone affected and interviewed them and recorded the nature and extent of their property losses. There has been no expert valuation of property losses. No invoices or other documents have been provided. The claims are very vague and extend beyond property damage. For example plaintiff No 1281, Malai Wanpis, deposes in his affidavit after setting out his personal circumstances (he was at the time of the eviction exercise aged 38 and had five children and had been living at Kandi settlement for 18 years) that:


... my properties and personal effects destroyed were as follows:

19. It is clear that items (7) to (12) totalling K16,970.00 are not claims for property damage, yet they make up 40.6% of what purports to be a claim for property damage. Mr Meten has conceded that the evidence is deficient as he has submitted that it would be appropriate to award 50% of the amount of damage claimed by each plaintiff. The total amount claimed for destruction of property in the plaintiffs' evidence is K27,171,527.62, whereas the amount claimed in submissions is K13,585,763.81.


20. Should the amounts claimed in the statement of claim be discounted more on the 50% conceded by the plaintiffs? Should the claims be discounted by 95% as submitted by the defendants? Should the claims be discounted by some other amount? Should the claims be totally rejected in view of the absence of corroboration?


21. Each case must be judged on its merits and the quality of evidence before the court. I have addressed these sorts of issues in a number of previous cases. In Joe Tipaiza v James Yali (2008) N3472 the 220 plaintiffs claimed property losses of K3.9 million following an unlawful squatter eviction exercise by police and the provincial government in Madang town. I discounted each of the claims by 50% in view of deficiencies in the evidence. In Eton Pakui v The State (2006) N2977, a case involving an unlawful police raid of Tulipato village in Enga Province, I discounted the 16 claims by 90%. In Justin Bau v Paul Karl (2010) N4123 there were 61 plaintiffs who were the victims of a police raid at Muledami settlement in the hilltops around Kimbe, West New Britain. In an assessment of damages following entry of default judgment against the State I concluded that the claims were exaggerated but because of the lack of precision in the amounts being claimed by each plaintiff I awarded them each a flat figure of K10,000.00, rather than discounting each claim as in Tipaiza and Pakui. In Anuta Jobou v Alfred Kumasi and The State (2012) N4607, a case involving an unlawful police raid of Bom village in the Rai Coast district of Madang Province in which houses were burned down and property including livestock destroyed, the claims by the 155 plaintiffs were discounted by 50%.


22. In this case the approach taken in Tipaiza, Pakui and Jobou is the preferable one. I consider that the interests of justice lie in accepting that each of the plaintiffs should receive an award of damages. However, the quality of the evidence is not as strong as it was in Tipaiza and Jobou, it is more akin to that in Pakui. I will discount each claim by 90 per cent to take account of the deficiencies in the evidence. For example for plaintiff No 1281 Malai Wanpis:


23. The awards of damages for all plaintiffs are shown in the schedule at the end of this judgment. Each plaintiff has been allotted a number corresponding to the number allocated to them in the schedule to the writ of summons (the originating process by which the proceedings were commenced). There are some plaintiffs in respect of whom no evidence has been provided, in which case the words "No evidence", appear next to the plaintiff number.


Deceased plaintiffs


24. Amongst the plaintiffs' evidence are affidavits of 53 persons who say that he or she is the next of kin of a plaintiff who has died. Mr Meten submits that the evidence of these persons should be accepted at face value and that the court should award damages to each deceased plaintiff's personal representative. The defendants argue that nothing should be awarded in respect of the deceased plaintiffs as the claims made on their behalf are incompetent and an abuse of process.


25. I see no merit in the defendants' argument. When a person dies his or her legal rights and obligations do not necessarily die with them (Lepanding Singut v Kelly Kinamun (2003) N2499, Kembo Tirima v Angau Memorial Hospital Board (2006) N3106). The general rule arising from Section 34 (effect of death on certain causes of action) of the Wrongs (Miscellaneous Provisions) Act is that if a person dies any cause of action vested in them at the time of death survives for the benefit of their estate. Section 34(1) states:


Subject to this section, on the death of a person ... all causes of action subsisting against or vested in him survive against or for the benefit of, as the case may be, his estate.


26. The claims on behalf of the deceased plaintiffs will not be struck out. However, the court has to be careful about making orders in favour of persons who say that they should be paid money on behalf of deceased plaintiffs. There might be other people wanting to make a claim for the same money. The safest course of action and that which is required by law is to order that the money be paid into the estate of the deceased. I think it is safe to presume that most of the deceased plaintiffs would have died intestate (without leaving a will), in which case their estates will be automatically vested in the Public Curator under the Wills, Probate & Administration Act and administered according to that law (Public Curator v Peter Pilembo (2008) N3487, Cecilia Bonny v Dorothy Amino (2009) N3591). As for any case in which the deceased has left a will, it is still proper that the estate be deemed to have vested in the Public Curator (as the executor will be able to make an appropriate application to the Public Curator). I will therefore order that in respect of those plaintiffs who are deceased persons (marked * in the Schedule at the end of this judgment) the judgment sum be awarded to the estate of the deceased and paid to the Public Curator to be administered according to law.


4 SHOULD THE PLAINTIFFS BE AWARDED INTEREST?


27. In the statement of claim the plaintiffs claimed "8% interest pursuant to statute". This is a vague claim, however the defendants have not taken issue with it and I regard it as a claim for interest under the Judicial Proceedings (Interest on Debts and Damages) Act Chapter No 52. Section 1 is the appropriate provision. It states:


(1) Subject to Section 2, in proceedings in a court for the recovery of a debt or damages the court may order that there be included in the sum for which judgment is given interest, at such rate as it thinks proper, on the whole or part of the debt or damages for the whole or part of the period between the date on which the cause of action arose and the date of the judgment.


(2) Where the proceedings referred to in Subsection (1) are taken against the State, the rate of any interest under that subsection shall not exceed 8% yearly.


28. As Bredmeyer J pointed out in Cheong Supermarket Pty Ltd v Pery Muro [1987] PNGLR 24, this section confers a four-fold discretion on the Judge: (1) whether to grant interest at all; (2) to fix the rate; (3) to grant interest on the whole or part of the debt or damages for which judgment has been given; and (4) to fix the period for which interest will run. I exercise that discretion in the following way: (1) A plaintiff should in the normal course of events receive interest. There is nothing that takes this case out of the ordinary in that regard. Interest will be included in the sum for which judgment is given. (2) The rate of interest commonly used by the courts is 8%. In view of prevailing interest rates this could be considered generous. However, 8% is the rate pleaded in the statement of claim, it is the maximum rate that can be applied in proceedings against the State and no objection has been taken to it by the defendants, so it is the rate that will be applied. (3) Interest should be payable on the whole of the amount of damages awarded to each plaintiff. (4) The appropriate period for which interest is to run is from the date of service of the writ (1 November 2006) to the date of judgment (16 May 2013), a period (rounded out to decimal points) of 6.54 years. Interest will be calculated by applying the following formula D x I x N = A, where:

CONCLUSION


29. Each plaintiff will be awarded the sum of damages and interest in accordance with the formula D + A = J, where:

K4,177.00 + K2,172.04 = K6,349.04.

  3. Damages for destruction of property claimed in the plaintiff's affidavit;
  4. Damages awarded: 10% of the figure in column 3;
  5. Interest awarded: 0.52 x the figure in column 4;
  6. Judgment sum: being column 4 + column 5.

The total amount of damages awarded to all plaintiffs is K2,717,152.76, the total amount of interest awarded to all plaintiffs is K1,412,919.44; and the total judgment sum in respect of all plaintiffs is K4,130,072.20.


COSTS


30. The general rule is that costs follow the event, ie the successful party has its costs paid for by the losing party on a party-to-party basis. The question of costs is a discretionary matter. As the plaintiffs have only partially succeeded with their claims there might have been an argument for an award of less than all the plaintiffs' costs. However the argument has not been ventilated and in view of the fact that the plaintiffs were required to prove their case at two separate trials and that they have been directly affected by serious unlawful conduct on the part of the Police it is in the interests of justice that all their costs should be borne by the defendants. I will order the defendants to pay all the plaintiffs' costs.


ORDER


(1) Damages are payable by the defendants to the plaintiffs as prescribed by "damages awarded" in the Schedule.

(2) Interest is payable by the defendants to the plaintiffs as prescribed by "interest awarded" in the Schedule.

(3) A total judgment sum being damages plus interest is awarded to each plaintiff as prescribed by "judgment sum" in the Schedule, subject to the condition that in respect of those plaintiffs who are deceased persons (marked * in the Schedule) the judgment sum is awarded to the estate of the deceased and shall be paid to the Public Curator to be administered according to law.

(4) The plaintiffs' lawyers shall serve sealed copies of the judgment and order of the Court on the Public Curator within seven days after date of entry of the judgment.

(5) All of the plaintiffs' costs of and incidental to the trial on assessment of damages shall be paid by the defendants to the plaintiffs on a party-party basis, to be taxed if not agreed.
