AN ACT to amend the Medical Practitioners Act 1975
[5 September 1980]
BE IT ENACTED by the Legislative Assembly of Western in Parliament assembled as follows:
1. Short title - This Act may be cited as the Medical Practitioners Amendment Act 1980.
2. Principal Act - The Medical Practitioners Act 1975* is in this Act referred to as the Principal Act. * 1975, No. 15
3. Register to be kept by Secretary - Section 10 of the Principal Act is amendment by omitting from paragraph (c) of subsection (1) "are temporarily registered under section 16" and substituting "have been issued with a temporary certificate of permission to practise medicine or surgery or both, as the case may be, under section 16".
4. Certificate of practice - Section 17 of the Principal Act is amended by repealing sub-section (5) and substituting the following sub-section:
"(5) No person shall practise medicine or surgery in a private capacity in Western Samoa unless -
(a) he is registered as medical practitioner under this Act;
(b) he is the holder of a current practising certificate under this section;
(c) he has the necessary practical experience required by sub-section (4); and
(d) he has a current practising certificate endorsed by the Council under section 17A."
5. Council may endorse certificate - After section 17 of the Principal Act, the following section is inserted:
"17A. Council may endorse certificate
The Council may, where a person complies with paragraphs 17(5)(a), (b) and (c), endorse the current practising certificate indicating that the holder of a current practising certificate may practise medicine or surgery in a private capacity in Western Samoa subject to such to such terms and conditions as the Council may determine as endorsed on that certificate."
6. Regulations - Section 34 of the Principal Act is amended by repealing paragraph (f) from sub-section (2) and substituting the following paragraphs:
"(f) Prescribing the control of the professional conduct of registered medical practitioners and the practice of the profession; and
(g) Prescribing the imposition of fines not exceeding $50 for the breach of any regulation."
