Police v Fuamatu [2010] WSSC 63 (26 April 2010)

IN THE SUPREME COURT OF SAMOA
HELD AT MULINUU

BETWEEN:

THE POLICE
Informant

AND:

ALISA FUAMATU
male of Laulii.
Defendant

Counsels: Ms L. Su'a for the prosecution
Defendant in person

Sentence: 26 April 2010

SENTENCE

Alisa I am sure you have heard what I said to the previous defendant about a previous conviction for the same offence. You appear for sentence on a charge of possession of narcotics. You were in prison for that in 2002 and 2003. There is no room for leniency for repeat drug offending. The only thing saving you from a long term in prison is the relatively small quantity of leaves involved in this matter but the summary of facts that you have agreed to says that you were caught in possession of two 2"x3" plastic bags of dried marijuana leaves. That is not a small quantity. If you want to stay out of prison you must stay away from drugs because with your record Alisa every time you come back on drug offending it is prison.

In respect of this matter of possession of narcotics you are convicted and sentenced to 12 months in prison.

JUSTICE NELSON
