CIVIL AVIATION (AMENDMENT)
ACT NO. 27 OF 2016

An Act to amend the Civil Aviation Act [CAP 258].

Be it enacted by the President and Parliament as follows-

1. Amendments

The Civil Aviation Act [CAP 258] is amended as set out in the Schedule.

2. Commencement

This Act commences on 1 January 2017.

AMENDMENTS OF THE CIVIL AVIATION ACT
[CAP 258]

1. Subsection 46(2)

Repeal the subsection, substitute

“(2) A levy may be imposed on:

(a) the holders of aviation documents of any class or classes specified in the Order and persons who, but for an exemption granted under this Act, would be required by this Act to hold an aviation document of the class or classes specified in the Order; or

(b) any international passenger departing Vanuatu.

(2A) The Minister may by Order exempt any person or any class of persons from payment of levy under this section.

(2B) For the purposes of paragraph (2)(b), international passenger means a passenger that is embarking on an international flight that is departing Vanuatu for a destination outside of Vanuatu.”

2. After paragraph 48(2)(b)

Insert

“(ba) specify the procedures for collecting levies; and

(bb) specify the procedures for the payment of levies by the persons specified in the Order; and”
