You are notified that the above proceeding filed in the Supreme Court of Vanuatu and registered as Civil Case No.1920 of 2021, has been struck out under rule 9.10(4) for non-compliance with court orders and failing to take any step in the proceeding for 15 months. The claimant was put on notice about the consequences of non – compliance in the minute of 19 May 2023, which is that the claim should be struck out without reference to the parties. The claimant did not satisfy the Court that there was good and proper reasons why the claim should not be struck out.
