SENTENCE


  1. Introduction
  1. Mr Esau pleaded guilty to threat to kill.
  1. Facts
  1. On 2 May 2018 at Pangpang, Forari area on Efate, Mr Esau trespassed onto lease title no.12/0741/007 which is owned by the complainant Freddy Boblang and others. MrBoblang and his workmen were there bulldozing an access road.
  2. Mr Esau verbally threatened to kill Mr Boblang by pointing his finger towards him and telling him that he would take his rifle in Vila and blow Mr Boblang’s brains out. This caused MrBoblang to fear for his life.
  1. Sentence Start Point
  1. The sentence start point is assessed having regard to the maximum sentence available, and the mitigating and aggravating factors of the offending.
  2. The maximum sentence provided in s. 115 of the Penal Code [CAP. 135] is 15years imprisonment.
  3. There are no mitigating aspects of the offending.
  4. The offending is aggravated by:
  5. The factors set out above require a sentence start point of 3years imprisonment.
  1. Personal Factors
  1. Mr Esau pleaded guilty but not at the first opportunity. His guilty plea is a sign of remorse and has saved further Court time and expense. I deduct 20% from the sentence start point for the guilty plea.
  2. Mr Esau is 63 years old. He is a father and grandfather.
  3. He has no previous convictions.
  4. The complainant declined Mr Esau’s offer for a custom reconciliation ceremony.
  5. For MrEsau’s personal factors, I deduct 4 months from the sentence start point.
  1. End Sentence
  1. Taking all of those matters into account, the end sentence imposed is 2 years 1 month imprisonment.
  2. The sentence is imposed to deter Mr Esau and others from such offending, to hold Mr Esau accountable for his criminal conduct and to protect the community.
  3. The sentence is suspended for 2 years. MrEsau is warned that if he offends again within the next 2years, he will need to serve the sentence in addition to any other penalty that may be imposed on him for the further offending.
  4. In addition, Mr Esau is to complete 60 hours of community work.
  5. Mr Esau has 14 days to appeal.
