IN THE SUPREME COURT OF Judicial Review
THE REPUBLIC OF VANUATU Case No. 20/3369 SC/JUDR
(Civil Jurisdiction)
BETWEEN: Dorosday Kenneth Watson
Claimant
AND: Republic of Vanuatu
Defendant
Date of Trial: 29 April 2021
Before: Justice V.M. Trief
In Attendance: Claimant – Mr M. Hurley
Defendant – Mr S. Aron
MINUTE & ORDERS
- The Defendant through the Council of Ministers has revoked the decision under challenge.
- It follows that the Claimant is entitled to costs. She seeks costs on the standard basis. The Defendant’s position as set out
in its Memorandum filed 22 April 2021 is that costs should be awarded on the standard basis. To avoid further costs being incurred,
counsel agreed that the Court summarily fix the costs of this matter, having heard from the parties as follows:
- The Claimant is to file and serve a Memorandum as to the quantum of costs on the standard basis by 4pm on 3 May 2021;
- The Defendant is to file and serve submissions in response by 4pm on 10 May 2021.
- I will fix the quantum of costs on the papers thereafter.
DATED at Pora this 29th day day of April 2021
BY THE COURT
