MINUTE


  1. Mrs.Vire informs the Court that the Minister of Lands has registered the Claimant's leases in compliance with the Orders issued on 21st October and 30th October 2013 respectively. Counsel informs the Court that the Court award costs of those applications at VT20,000 and VT5,000 but those costs have not been paid by the Defendant to date. Mrs.Vire informs the Court the Claimant has instructed her to discontinue this proceeding against the Defendant and that for record purposes Counsel would be filing a Notice of Discontinuance in due course.
  2. Mr.Gilu confirms the position and asks for 21 days for the Defendant to pay off the outstanding costs at VT25000.

ORDER


  1. Accordingly it is Ordered that-

This proceeding be wholly discontinued against the Defendant. As a result the proceeding be struck out.


The outstanding costs of VT25000 awarded in favour of the Claimant be paid by the Defendant within the next 21 days.
