ORDER


By Notice of Hearing dated 25th February 2005 the Claimant’s application made on an urgent basis was listed for hearing. The application is supported by an affidavit of urgency of Varucu Mele dated 15th February and a sworn statement from Maile Vatu, claimant’s brother. None of these persons are present in Court today.


Under those circumstances I hereby dismiss the Claimant’s application for restraining Orders against the defendant.


There remains the Supreme Court Claim. I adjourn it for a Conference on Friday 18th March 2005 at 0830am hours when Counsel Mr Tavoa will be in Luganville so he and the Claimant may be heard.
