ORDER

By Notice of Hearing dated 25^th February 2005 the Claimant’s application made on an urgent basis was listed for hearing. The application is supported by an affidavit of urgency of Varucu Mele dated 15^th February and a sworn statement from Maile Vatu, claimant’s brother. None of these persons are present in Court today.

Under those circumstances I hereby dismiss the Claimant’s application for restraining Orders against the defendant.

There remains the Supreme Court Claim. I adjourn it for a Conference on Friday 18^th March 2005 at 0830am hours when Counsel Mr Tavoa will be in Luganville so he and the Claimant may be heard.
