Lo v Coconut Oil Production (Vanuatu) Ltd [2005] VUSC 41; Civil Case 007 of 2005 (8 April 2005)

IN THE SUPREME COURT OF
THE REPUBLIC OF VANUATU
(Civil Jurisdiction)

Civil Case No. 7 of 2005

BETWEEN:

RICHARD LO
Claimant

AND:

COCONUT OIL PRODUCTION (Vanuatu) LTD
Defendants

ORDER

This case was called for conference on 1st April 2005. The Notice of Conference was issued on 25th February 2005. No parties or counsel were present. However Mr Nigel Morrison’s letter dated 29th March 2005 was brought to the Court’s attention. There was no response from counsel acting for the Defendants.

Mr Morrison indicates in his letter that the matter is likely to settle. The Court understands by that indication although the Defendant has not confirmed that negotiations are in progress to settle the matter. The Court would urge parties to continue to pursue that course. In the meantime the Court will issue the following orders:-

(1) The matter be adjourned to Monday 18th July 2005 at 0830 hours for Mention or Conference.

(2) in the event that the matter is settled before that date, Claimant is to file a Notice of Discontinuance.

(3) There be no order as to costs.

DATED at Luganville this 8th day of April, 2005.

BY THE COURT

OLIVER A. SAKSAK
Judge
