ORDER
Upon hearing Mr. Robert Sugden for the plaintiff and Ms Kershaw of the State Law Office for the defendant, IT IS HEREBY ORDERED as follows:-
1. That the defendant, within seven (7) days of the date of this Order, make discovery by making, filing and serving an Affidavit of Documents.
2. That unless the defendant, within seven (7) days of the date of this Order, make discovery as in paragraph 1 hereof, his defence is struck out and judgment shall be entered for the plaintiff for:-
(i) VT2,239,375
(ii) Damages to be assessed for loss of use of money and exemplary damages
(iii) Costs.
3. That, in the event that the defendant makes discovery within seven (7) days after the time limited by paragraph 1.
(i) Inspection of Documents within seven (7) days after the time limited by paragraph 1.
(ii) Seven days after the time for inspection for the parties to deliver any further interrogatories should they wish to do so.
(iii) Seven (7) days thereafter for sworn answers to interrogatories to be filed and served.
4. That the matter is fixed for further and final conference on 15 November 2000 at 8.00am o'clock in the morning.
5. That this matter is fixed for 3 days trial (11-12-13 December, 2000). The trial will begin on Monday 11 December 2000 at 9.00am o'clock in the morning.
6. That the defendant is ordered to pay the costs of today's hearing of Vatu 10,000 to the plaintiff.
