Public Prosecutor v Legall [1999] VUSC 23; CRC 030 1998 (27 April 1999)

IN THE SUPREME COURT OF
THE REPUBLIC OF VANUATU

CRIMINAL JURISDICTION

CR No. 30 of 1998

PUBLIC PROSECUTOR

-v-

MORGAN LEGALL

Public Prosecutor for the State
Geoffrey Gee & Partners for the Defendant.

ORDER

Matter for trial this morning.

Application by Public Prosecutor for nolle prosequi, reasons being that there are no strong evidence against the accuse in this matter, in that the first test of the substance were negative. The second test was positive but did not go through a second test to confirm that. Further the amount of the substance was very little and could not proceed with the matter in this trial. This is in support for the application for nolle prosequi.

Court: application accepted

ORDER:

The case is now dismissed. The Defendant is hereby discharged.

DATED AT PORT VILA this 27th April 1999.

R. MARUM MBE
JUDGE

Mrs. Heather LEO for the Public Prosecutor
Mr. John MALCOLM for the Defendant.
