JUDGMENT

The accused, SAIREL SANO, was charged that on a day unknown in June, 1967 at Vila he stole 3,000 francs, the property of JONAH UNGAI of Paama. To this charge he pleaded guilty.

The Public Prosecutor, Cmdt. WALFORD, outlining the facts of the case, said that on a day in June, 1967 the complainant and the defendant, with some others, were sleeping in a common lodging house in Vila. In the morning the complainant found that 3,000 francs, which he had left in his pocket, were missing. Later, he taxed the accused with taking the money and the accused admitted that he had.

The Public Prosecutor told the Court that the accused has two previous convictions for dishonesty, in respect of each of which he received four months' imprisonment.

Me. PUJOL, the Native Advocate, pleading in mitigation, told the Court that almost immediately after the theft the accused had repaid fifteen dollars of the money taken, but that shortly thereafter he broke his leg in a motoring accident and was unable to make any further restitution until today, when he paid back a further eleven dollars. He told the Court that this theft took place when the accused was drunk. He stressed the youth of the accused, who, at the time of the offence, was only 20 years.

The Court accepts the plea of guilty, convicts the accused and sentences him to 6 months' imprisonment with a stay on the execution of the sentence for a period of 12 months. In the event of the accused not being convicted for any other offence within that period, the sentence of 6 months to lapse.
