EX-PARTE ORDER

Upon hearing the applicant Gilbert Mermer and upon the usual undertakings as to damages, the Court hereby Orders that:-

1. Elizabeth Mermer is restrained from removing the children namely Caroline 15 years old, Kaltoi 10 years old and Karina 1 year old from their matrimonial home at York Street, Independence Park in Port Vila until the Court so orders.

2. Elizabeth Mermer has the right to go and see the children at their matrimonial home whenever she wants to just as long as such visits are not used to further disturb the applicant and the children.

3. Elizabeth remain on the Island of Efate until such time as this matter was resolved by the Court.

4. A copy of this Orders [sic] is served on Mr. and Mrs. Kaltoi Wabaiat, with when [sic] the Respondent is currently residing.

The Respondent bears the cost of the application.
