Kalmer v Willion [2008] VUIC 9; Civil Case 56 of 2005 (30 October 2008)

IN THE MALEKULA ISLAND COURT
OF THE REPUBLIC OF VANUATU
(CIVIL JURISDICTION)

Civil Case No. 56 of 2005

BETWEEN:

LEIMATA KALMER
Plaintiff

AND:

RIKI MANSEN WILLION
Defendant

ENFORCEMENT ORDER

The parties in this case are not present this morning. The court is satisfied the defendant has been served with a notice of today's hearing. The defendant has failed to appear. The plaintiff could not appear as she resides in Efate.

And having perused the file herein, it is clear that the defendant has been originally ordered to pay the amount of VT 8000 monthly as maintenance for 2 children. He has continuously failed to comply with such order with other enforcement orders of this court. Such failures had amounted to the balance of VT307,000 as of date.

Given the facts, I have no other alternatives but order that the defendant pay the amount of VT50,000 before the end of November, 2008. Default of such payment will result with imprisonment of 6 months.

Dated at Lakatoro this 30th day of October, 2008

ORDER OF THE COURT

EDWIN MACREVETH
Supervising Magistrate
