1. At the outset of the hearing of this appeal Mr Boar informed the Court that he had withdrawn his appeal and had informed Mr Morrison prior to the commencement of the hearing.
   
2. Mr Morrison confirmed the prior discussions between them and that Counsel had agreed there be no order as to costs.
   
3. Accordingly the Orders of the Court are that:-
   1. The appeal be dismissed, and
   2. There be no order as to costs.
