Namuly v Public Prosecutor [2011] VUCA 2; Criminal Appeal 01 of 2011 (4 April 2011)

IN THE COURT OF APPEAL THE REPUBLIC OF VANUATU
(Criminal Appellate Jurisdiction)

Criminal Appeal Case No. 01 of 2011

BETWEEN:

JERRY JEFFREY NAMULY AND ANDREW JEFFREY NAMULY
Appellant

AND:

PUBLIC PROSECUTOR
Respondent

Coram: Hon. Justice John Mansfield
Hon. Justice Taniela Fatiaki
Hon. Justice Robert Spear
Hon. Justice Raynor Asher

Counsel: Mr J Kausiama for the Appellants
Mr S Blessing for the State

Hearing: 4 April 2011

RULING AND ADJOURNMENT

  1. These appeals were set down for hearing during this session. However, counsel acting for the appellants at the time that the appeals were commenced has recently withdrawn. This has left the appellants without legal representation. The case was stood down so that the Public Solicitor could confer with the appellants.
  2. Mr Kausiama, of the Public Solicitor's Office, is now acting for the appellants and he has had the opportunity to discuss the appeals with them. However, he requires further time to prepare for the appeal hearing and he seeks to have the appeal heard in the next session in July 2011.
  3. It is appropriate that counsel now acting for the appellants have time to prepare for the hearing of the appeals. Accordingly, the appeals are removed from this session and relisted for hearing in the next session.

Dated at Port Vila, this 4th day of April, 2011

BY THE COURT

Hon. Justice J. MANSFIELD

Hon. Justice T. FATIAKI

Hon. Justice R. SPEAR

Hon. Justice R. Asher
