SHIPPING (AMENDMENT) ACT 2022

AN ACT TO AMEND THE SHIPPING ACT [CAP 22.09]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. Short Title and Interpretation

(1) This Act may be cited as the Shipping (Amendment) Act 2022.

(2) In this Act, the Shipping Act [Cap 22.09], as amended, shall be referred to as the “Principal Act”.

2. Section 122 amended

Section 122 of the Principal Act is amended by deleting subsection (2) and replacing it with the following -

“(2) Where a ship proceeds to sea in contravention of subsection (1) the owner of the ship and its master commit an offence and are liable on conviction to a fine not exceeding $50,000, or to a term of imprisonment not exceeding 5 years, or both, and in either case the ship is subject to forfeiture to the Crown.”.
