CRIMINAL OFFENCES (AMENDMENT) (NO.6) ACT 2022

AN ACT TO AMEND SECTION 143 OF THE CRIMINAL OFFENCES ACT [CAP 4.04]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. Short Title and Interpretation

(1) This Act may be cited as the Criminal Offences (Amendment) (No.6) Act 2022.

(2) In this Act, the Criminal Offences Act [Cap 4.04], as amended, shall be referred to as the “Principal Act”.

2. Section 143 amended

Section 143 of the Principal Act is amended by numbering the current provision as subsection (1) and by inserting the following new subsection (2) -

“(2) A person appropriating property belonging to another without meaning the other permanently to lose the thing itself is nevertheless to be regarded as having the intention of permanently depriving the other of it if his intention is to treat the thing as his own to dispose of regardless of the other’s rights; and a borrowing or lending of it may amount to so treating it if, the borrowing or lending is for a period and in circumstances making it equivalent to an outright taking or disposal.”.
