BAIL (AMENDMENT) ACT 2022

AN ACT TO AMEND THE BAIL ACT [CAP 3.01]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. Short Title and Interpretation

(1) This Act may be cited as the Bail (Amendment) Act 2022.

(2) In this Act, the Bail Act [Cap 3.01], as amended, shall be referred to as the “Principal Act”.

2. Section 3 repealed

Section 3 of the Principal Act is hereby repealed.

3. Section 4 amended

Section 4 of the Principal Act is amended by –

(a) deleting the current section heading and replacing it with “4 Bail upon arrest or charge”; and
(b) inserting the following new subsections (4) and (5) immediately after subsection (3) –

• “(4) In determining the question of bail under this section, the Court need not apply the strict rules of evidence, and an informal enquiry by the Court may suffice.
• (5) A person charged with murder or treason may be granted bail only by the Supreme Court or Court of Appeal.”.
