IN THE SUPREME COURT OF TONGA
CRIMINAL JURISDICTION
NUKU'ALOFA REGISTRY

CR 95/2011

REX

V

SOANA HALAUAFU

BEFORE THE HON. JUSTICE CATO

SUMMARY OF SENTENCE

The prisoner pleaded guilty to one count obtaining $15,000 from the complainant by a false pretence namely that she would make and supply Tonga artifacts for her. In fact she contracted the work out and little was done. She spent the money on family.

It was an exceptional family matter.

The complainant was a relative and the items were for a wedding.

The complainant accepted the prisoner's apology

Some doubt as to the validity of the original charge and the particulars had to be amended so as to incorporate a misrepresentation of existing fact.

The priosner was aged 25 - no previous convictions - remorseful - 2 children - supportive husband

IT IS ORDERED THAT:

1. The prisoner is bonded to be of good behaviour under s 198 criminal offences Act for a period of12 months

DATED: 30TH AUGUST 2012 JUDGE
