Order for sale — Writ of Certiorari.
O. B. K., through Mr. C. E. Walton make application for Order to Sell. Amount owing £50 and costs amounting to £9/9/0. Nothing paid to date.
Takai asks for an extension to December 30th as he intends to arrange a "No" and to sell 160 kits of yams at 4/ — in Ha'apai.
5/2/36. Mr. Walton called and stated to the Registrar no payment.
Writ of Certiorari therefore made and issued this day.
12/2/36. Mr. Walton and Takai present. No payment made — Takai admits this. Order to sell in 14 days from today granted.
EDITOR'S NOTE:
This is a verbatim report of a note made by the Acting Chief Justice. It is included in these reports to show that Certiorari runs in Tonga, and so probably the other prerogative writs although there is no mention in the Laws of any of them with the exception of Habeas Corpus. There are references to grants of writs of certiorari in the notes of earlier judges, but no details are given.
