Tu'akalau v Rex [2014] TOCA 28; AC 13 of 2012 (31 March 2014)

IN THE COURT OF APPEAL OF TONGA
CRIMINAL JURISDICTION
NUKU'ALOFA REGISTRY

AC 13 of 2012
[CR 207 of 2010]

BETWEEN

'ANAMALIA TU'AKALAU
Appellant

AND

REX
Respondent

Mr Pouono for the Appellant
Mr Sisifa for the Respondent

MINUTE OF THE COURT

[1] This appeal against conviction alleges that there was no factual basis for the jury's verdict. Leave to appeal was refused by the President of the Court of Appeal.
[2] Mr Pouono who was not the counsel who appeared at trial, now seeks leave from the full Court of Appeal. However in order for him to pursue this application he needs the transcripts of the evidence adduced by the Crown. He seeks an adjournment to enable these to be prepared. The Crown does not oppose the application for adjournment.
[3] We are prepared to grant an adjournment and we order that the transcripts be prepared.
[4] Upon receipt of the transcripts Mr Pouono is to advise the Court whether he wishes to proceed with the appeal.
