POLICE ACT 2013

POLICE (POLICE OFFICERS' ASSOCIATION) REGULATIONS 2013
IN exercise of the powers conferred upon me by section 218 of the Act, I make these Regulations –
Citation
1. These Regulations may be cited as the Police (Police Officers' Association) Regulations 2013.
Interpretation
2. In these Regulations –
"Association" means the Police Officers' Association established by regulation 3.
"Central Committee" means the Central Committee established under regulation 6.
"Executive Committee" means the Executive Committee established under regulation 9.
Establishment of Association
3. There is hereby established an association known as the Police Officers' Association.
Objects of the Association
4. The objects of the Police Officers' Association are to provide –
(a) welfare services to Police Officers and their families;
(b) services to improve the efficiency of police officers;
(c) social, sporting, educational and recreational services and activities;
(d) cultural services and activities;
(e) advocacy services to bring issues relating to employment, conditions of service, occupational health and safety issues and other workplace issues to the attention of the Commissioner, the Minister and the National and Provincial Governments.
Membership of the Association
5. All Police Officers are declared to be members of the Association.
Central Committee
6. There shall be established a Central Committee through which the Association shall act.
Membership of Central Committee
7. (1) The Central committee shall consist of the following members of the Association –
(a) 2 to be elected by members of the Association serving in Guadalcanal Province;
(b) 2 to be elected by members of the Association serving in Malaita Province;
(c) 2 to be elected by members of the Association serving in Central Province;
(d) 2 to be elected by members of the Association serving in Isobel Province;
(e) 2 to be elected by members of the Association serving in Makira Province;
(f) 2 to be elected by members of the Association serving in Renbel Province;
(g) 2 to be elected by members of the Association serving in Temotu Province;
(h) 2 to be elected by members of the Association serving in Western Province; and
(i) 2 to be elected by members of the Association serving in Choiseul Province.
(2) The Central Committee shall hold its first meeting within one month of election from a date to be fixed by the Commissioner.
(3) At the first meeting, the Central Committee shall elect a Chairman and a Secretary from its members.
Election of Central Committee
8. (1) Elections to the Central Committee shall be held every two years on a date and in a manner directed by the Commissioner.
(2) If the Central Committee has less than a quorum of eligible members any time, elections shall be held as soon as practicable for the vacant positions.
(3) Every member of the Association serving in each province shall have the right to stand for election and to vote at the election for the members of the Central Committee to represent that province.
(4) The Central Committee may, by nomination of persons qualified to be elected to the vacancy, fill any vacancy on the Committee caused by resignation, retirement or by ceasing to serve in the province from which elected.
Executive Committee
9. (1) There shall be established an Executive Committee to administer the Association.
(2) The Executive committee shall consist of –
(a) the Chairman and Secretary of the Central Committee; and
(b) three other members of the Central Committee elected by the members of the Central Committee.
Procedure and quorum
10. (1) The Chairman at any meeting of the Central Committee and the Executive Committee shall have a casting vote as well as a deliberative vote.
(2) The quorum of the Central Committee shall be 10 and the quorum of the Executive Committee shall be 3.
(3) Subject to the provisions of this Regulation, the Committees may regulate their own procedures, including the appointment of committees and sub-committees.
(4) The Secretary of the Central Committee shall keep minutes of every Central Committee and Executive Committee meeting and shall forward two copies of the minutes to the Commissioner, one copy to each member of the Central Committee and one copy to each Provincial Commander within 30 days after each meeting.
(5) Members of the Central Committee and Executive Committee may attend meetings by radio, telephone, video link or other electronic means or devices as approved by the Central Committee.
Representations by Central Committee
11. The Central Committee may at any time submit representations in writing to the Commissioner and, through the Commissioner, to the Minister or Prime Minister and shall consider and report upon any matters referred to it by the Commissioner, Minister or Prime Minister.
Attendance deemed to be duty
12. Except where an officer is required for duty and no substitute is available, officers elected to the Central Committee shall be given leave to attend Central Committee meetings and attendance shall be deemed to be an occasion of duty.
Interim Committee
13. (1) The first election of the Central Committee shall be held within 3 months from the date of the establishment of the Association.
(2) Prior to the first election of the Central Committee, their shall be an Interim Committee consisting of the last elected members of the Subordinate Police Officers' Association and the Senior Police Officers' Association.
