THE ISLANDERS DIVORCE (AMENDMENT) ACT 1998
(NO. 1 OF 1998)
Passed by the National Parliament this ninth day of April 1998.
Assented to in Her Majesty's name and on Her Majesty's behalf this eighth day of May 1998.
AN ACT To Amend the Islanders Divorce Act Cap 48.
ENACTED by the National Parliament of Solomon Islands.
Short title.
1. This Act may be cited as the Islanders Divorce (Amendment) Act, 1998.
Amendment of section 5 of cap. 48.
2. Section 5 of the Islanders Divorce Act (hereinafter referred to as the "principal Act") is hereby amended in the following respects -
(a) by renumbering paragraph (d) as paragraph (e) thereof; and
(b) by inserting immediately before the paragraph so renumbered the following as paragraph (d) -
"(d) has lived apart from the petitioner for a continuous period of at least five years immediately preceding the presentation of the petition; or".
Amendment of section 8.
3. Subsection (2) of section 8 of the principal Act is hereby amended in the following respects -
(a) by renumbering paragraph (iii) as paragraph (iv) thereof; and
(b) by inserting immediately before the paragraph so renumbered the following as paragraph (iii) -
"(iii) where the ground of the petition is the ground of living apart for a continuous period of at least five years, referred to in section 5(1)(d), that the marriage has broken down irretrievably; and".
