Trade Disputes Panel of Solomon Islands |
IN THE TRADE DISPUTES PANEL
OF SOLOMON ISLANDS.
Case No. L9/13 of 1991
IN THE MATTER of the Trade Disputes Act 1981
AND IN THE MATTER of a referral
of a Trade Dispute
BETWEEN:
SINUW
Applicant
AND:
SOLOMON ISLANDS RED CROSS SOCIETY
Respondent
Hearing: 9th August 1995, Honiara.
Decision: 9th August 1995.
Panel: F. C. Luza - Chairman (Acting)
J. Adifaka - Employer Member
C. Karaori - Employee Member
Appearances: J. Ilifanoa, SINUW, for the Applicant
Mr. Kwan, for the Respondent.
AWARD
Upon its finding on 24/3/93 that the applicant Mr. Graham Zino had been unfairly demoted, the Panel had then decided not to consider any award pending the decision of the unfair dismissal case involving the same applicant. The panel will now do so.
In determining the award, however, both parties have agreed that the appropriate award applicable in this matter is a total sum of $12,285.00 being the loss of income suffered by the applicant in 1991 and 1992.
The Panel has therefore accepted and incorporated the consensus award of $12,285.00 as its award under section 7 of the Trade Disputes Act, 1981.
It is therefore directed that the Respondent is to pay the sum of $12,285.00 to the applicant immediately.
PANEL EXPENSES
The Panel has also directed that the respondent is to pay $100.00 towards panel costs within 14 days from receipt of this decision.
On behalf of the Panel,
F. C. Luza
CHAIRMAN (ACTING)
