STATEMENT OF CLAIM: Clement Reinunu the Plaintiff claims that the defendant Eliel Tagotada did work on his land at URAGAI without the owners permission.

PLEA: NOT LIABLE.

PLAINTIFFS SIDE:

Clement Reinunu, Sworn States: The plain known as Kolomatoba was in my hands. I hold it because my ancestors lived there in the past days. At a time of JOE LOVE the headman and a police man John Labe and Jack check put me and told me, and said to me, you Clement Reinunu, its good for you to go down to URAGHAI, and I then gather the Lakatana, Lusuruka and Kerana people and live with them. For our ancestors died and no one to look after them. I did what the headman said and we came down and build our homes there at URAGAI. We stayed around the plain there. We build all we need and a church. All who stayed there were under me. I lived there untill now, and never heard that this land belongs to Lakuili Line, no one came and even try to chase me out of this land During my stay there I made three big feast all who lived there gathered to me to join the feast. And no any of these Lakuili lines as Tago, ever stopped me to do this feasts. Or even chase me out. My grandmother Mrs Lusuisikai and my mothers Mrs Luvule told me that this land is mine with the bushes, they were buried in URAGBAI land, KILISI the son of the headman also told me the same thing as my grandmother and mother told me. Hearing and knowing that the land is mine, I started to cut the bushes at Kolomatoba to the main road at Galavuna, Boloda, and wont beyond the main road to TINA RIVER and planted 200 coconut trees on the other side of TINA RIVER known as CHIBA, there, I stop to work there with my people. I was looking after KAKAU and LAKUILI line of this area. I knew well that the plains at Kolomatoba situated at URAGAI LAND. Belongs to me. My great grandies put me there. I live on the land inside 40 years and did not hear any Lakuili lines claims that this land was his. The dispute came out only last year, when ELIEL TAGOTADA came and wanted to work there and stopped him twice, I put up the Notice Board and he spoiled it. I stopped him because I did not know him. If he owns this part why didn't he stopped me living on his land for such a long time. From Kakeuga to LERANA belongs to me. My ancestors lived there, and I followed them by using their land. KAKAUGA was where, TURAKAEA lived, then he came down to the plains below the hill and came to KUSAGE and VATUKAPITSA and POISUGU where he died and put the land on my hand.

STRAC INUVI lived at KERANA and then came down to VERA TITA and Kolotsimiu where he died and also put the land on my hands. BENJAMIN TATAO and MATAVATI also put the land on my hands. LOBOA also did the same, so thats all I can tell the Court.

Q. You told the court that no Lakuili line owned you which line do you married your own line?

A. I married Lakuili line, but they are under me or Kakau Line.

Q. Was TURAKAEA your tribe?

A. Yes.

Q. Did you see my spearline showed yesterday?

A. I saw it, but it's my land.

Q. Did you give any pig or money to anyone before or after using the land?

A. No, For I am following my ancestors who lived here before me.

1ST PLAINTIFF WITNESS

Samson Rasile Sworn States: Area shown yesterday belongs to us of the Kakau line. We owned it, for our ancestors used this part below at the plains as to make gardens and keep pigs. When the head of our Line died, people used it as a home, they lived 10 years before the war. During war my brother REINUNU and myself, came down there at URIHGAI and live there until today. We stayed there 50 years. During that time we did not hear any claims at all from the Lakuili line mentioning that the land belongs to them. But in 1979 Eliel Tagotada claims that this part of land belongs to him or the Lakuili line. KAKAU LINE lived there first and also first cut the bushes there. In 1935-1942 I can remembered this old mans lived, CHULU, MATARIU, BASILIO, INUVI TURAKAEA, LIVUTALUA, AREVUA & MATAVATI. Today Clement REINUNU and SAMSON RASILE.

Q. Are we talking about ENGLAND or our own Customary land?

A. We are not allowed to live on someone else ground.

Q. Was Chulu your really line?

A. Yes.

Q. Were all your ancestors named above your line?

A. Yes.

2ND P/W

BENJAMIN TATAO, Sworn States: The land we are talking about, when our ancestors alive and I sew them with my eyes. My uncle the head of our line, My sisters and brothers stayed there. ONE of our HEAD LINE was TSEBA, he stayed at Kerana and made big feast, the other was TAVULI, the one who was under them was MATAVATI my brother. The others were, TOBAINULI, LOBOA, INUVI, TURAKAEA, those are our Ancestors whom I saw with my eyes, and before them I could not tell the COURT, today you can see how old I am, I am after them, and after me Clement Reinunu, Samson Rasile, Lionga, Peroqolo and Jack Qeqe, those born after me. And today dispute just came up about the land. The other brother of mine was Sosopa.

A. Yes.

Q. Who was the first oldman before TAVULI?

A. TOBAGORO, TOBAI ADE, ADIKAVI, SPIU, ROKONA and then TAVULI.

Q. Were they KOITSIGI LINE?

A. Yes.

PEROQOLO, Sworn States: I can tell the court when TSEBA lived at KERANA And KAKAUGA. TURAKAEA started at VERA ULIA and came to KAKAUGA. Once they asked STRAC INUVI and TURAKAEA of KAKAU LINE Before building a small school at OGIO in the land talking about. Why didn't they ask Lakuili line. I saw this two old man with my eyes, all this that happens today did not happen during our past living when this old ancestors still alive.

Q. Did I argued with Koloqauqau or KOITSIGI Line?

A. Both are the same line.

Michael TIBA Sworn states: I stayed with my uncle at TAVUTINA with my uncle at TAVUTINA with my line the Lakuili and then came to live with the Kakau Line at KAKAVE and made our houses there. Myself with Kakau line cut the bushes there to Kakauga and made feast there with Kakau line there. When my uncle died the Kakau line stayed there. When they died, I live there. Then I came down to URAHGAI. And stayed there till today. While living there, I saw no Lakuili line there. If I saw Lakuili there then I would support them, thats all I could say.

Q. Did you hear from Kakau line that Lakuili owned part of this land?

A. No.

Q. Did you know of our coming to Kakauga?

A. I know.

Q. Did you know that a tambu place belongs to Lakuili at Kakauga?

A. I don't know.

5TH P/W

MISILISI, Sworn States: I remembered KAKAUGA was empty for a long time, I remembered that this land belongs only to KAKAU line. It was at Kolmatoba plains, the ancestors of Eliel Tagotada came to Kakauga and stayed under Kakau lines power. My ancestors told his ancestors before they came to Kakauga and do not own the spearline they showed us at URAGAI. When I grow up I never heard of any ancestors of Defendant to live at URAHAI. When my ancestors came down to URAHGAI, there was no place or village there. Every days of my life there I did not see any ancestors of the defendant among my tribe who lived there, I am older then any body here today. I only saw the defendant's ancestors at TSARIMALEGA and TINA RIVER SIDE. From KOITSIGI to KOTSITOA belongs to Kakau and not Lakuili line.

Q. Who were the names of the two old man of Lakuili and Kakau gave Kakauga to each other?

A. TUASURA, QELEVI, SAO, OLOBONGI & MANGAKOPE and MANGAVAKA.

6TH P/W

PENUS LIONGA, Sworn States: All I know about URABGAI land is that it belongs to Kakau line. Because when I came in 1956 untill today I never heard of any arguments between the two parties. So I knew that this land really belongs to Kakau line. My ancestors told me that this land belongs to kakau line. Their names were already named by the first witnesses. I can't say any further for all were already pointed out by the first witnesses. My belief is that the land belongs to Kakau.

Q. Who where the two person Kaka & Laukili lines gave Kakauga to each other?

A. TUA SURA of KAKAU and LAKUILI I don't know.

Q. Did you READ PROV. C 22 VI 28? Stated, "Remove not the LAND MARK"?

A. I did read, but I am witnessing what my elders told me.

7TH P/W

RENISI, Sworn States: I am from the Western Solomons. I came here in 1964 with Michal TOVA, relative of the Kakau Line. I stayed with Strack Inuvu at URAGAI. One day he told me that I can do any thing I wanted to do on this part of land. Starting from the last two years, I heard the defendant claims that this land was his or belongs to Lakuili line. Clement REINUNU the Plaintiff lived at URAHGAIA long time before I come here. In AUGUST 2nd 1964, an oldman named Philip asked me, whom did I came with, and I said with Michael TOVA, and asked me where were we were staying and I said at URAHAI. Then he said, you can live there that's the really place of Kakau line. Two big feast was done when I was with Clement REINUNU, and no one came and stopped him from doing this feast, that is why I believe the land known as URAHAI LAND belongs to Kakau Line.

Q. Can you chase a man doing feast in this land?

A. Yes. If he is not the landowner feasting in somebody's else land.

JOSUA LIGI, Sworn States: I am of Lakuili Line and uncle of the named defendant. I heard that URAHAI, belongs to Kakau lines. As far as I know Kakauga was given to Lakuili by the Kakau line. The below plains at Kolomatoba was different of TSEU. TSEU belongs to Kakau line.

Q. Is it good for you a Lakuili to destroy our own property?

A. I have right. I am afraid God might punish me of stealing other's land

Q. Did you know anyTambu place of Kakau from the hills to the bottom?

A. I don't know.

CHRISTIAN SOSOPA, Sworn States: I can't remembered much about this land. I never hear any story from my ancestors, saying that the URAHGAI belongs to the named defendant's ancestors.

Q. Are we talking about KAKARA or URAHAI?

A. I am witnessing where our Kakau Line owns.

Q. Were you from here or stranger?

A. Our ancestors put me here. I have right to witness this matter.

Seselun, Sworn States: I was born at KOTSITOA. And I knew Eliel Tagotada and Clement Reinunu, but I did not know where Lakuili owns there. I did not hear from my ancestors or other people saying that Lakuili owns a part of land at URAHAI.

Q. Last time you were my witness, now you were Kakau's witness Why?

A. I don't know that you are talking about URAHAI. I thought you are talking about your own part.

Q. Did you know a part where Lakuili owned there?

Al. I don't know.

DEFENDANT SIDE.

ELIEL TAGOTADA Sworn States: I am known as a LAKUILI LINE called GOROTAVULI. We came through TINA Head River at TSOKI, TORO came first to TSOKI, then to daolo, where TUQAVENUA owned and then we came to SALOTO, KOKOLE owned there and put a TAMBU place of the EAGLE, THEN to BULAGE where tola owned and TAMBU place of KAVEMATETORA there, then to KAKAUGA, the property or area of Kakauga reached down at URAHGAI. Spearline was at Kolomatoba on the right side and KUSAGI on the left. Upon the hill, Kakauga, VANGARUGU and TUANIGALI cut the bushes there and build homes there, then came GADOKESA and TUANIBOLI after them, and put 2 tambu places there called PELOPELO and TAVULI KENGE. Then GESE came up and put the TAMBU place of the EAGLE there, called SALOTOKIKI. GESE has three sons, SOGO, NGIDANA, KOLOBU of KAKAU VATUVULO, When GESE died, VOU, KUA, MANGANI, when they died the Kakauga was empty and bushes for a long time. TUGASALE started at TSAVUKADORA and came down to collect Ngalinuts there. One of our old ancestors lived at URAHAI named TUGATASIMARE. Tasimare's sons were VISULE and SERELE, MATAVATI married my grandmother, "Kidakidou" her childrens were LOVATOGOU. SERELE, VISULE, I saw then with my eyes. LOVA TOGOU is head of our LINE today. The Kakau lines says that Lakuili has not owned any ground there, but I remembered that PETER Brown TOBAINULI of Kakau line was taken here by my two grandys. He did not own this part of land. KERANA belongs to Kakau Line. I knew that I can't say a word about Kerana. I am talking only about Kakauga. C. Reinunu did not own Koitsigi, he claims that he owns there. Because his ancestors came and stayed there and made feast, he is not a Koitsigi line. Only the Gaubata and Kakau-Vatuvulo owned there. Rokona, Clement Reinunu's ancestor came and made feast there. But was not landowner there. Rokona came there because his pigs damages his brother inlaws garden and intend to kill him. So he ran away, thats why he came to KOITSIGI. Tugagulia was killed instead of him. Because he told him to run away to save his life. Tugagulia was killed at PITE. TUQARATSI, Solo, and Sipiu claimed by BENTATAO that they were his ancestors was not true, they were not his tribe, they were Kidipale and Valekuivi lines. I only wanted to talk with KOITSIGI line and not the other lines. I knew only that from Kakauga to Nanodaula belongs to me and the other parts I can't talk so much about for they belongs to Kakau lines.

Q. What is the different between VATUVULO and TSUANI LINES?

A. They were both Kakau Lines, but two branches.

Q. Can you remembered when ROKONA came to KOITSIGI?

A. No. No one knows how to use dates as we do today in those days.

Q. Can you tell me from Rokona to me today how many generations of us?

A. 6.

Q. To whom did 4 of your ancestors came at KAKAUGA? Did you see them?

A. I don't know, they came there to build home. I did not see them.

Q. Where were they were burried?

A. I don't know.

Q. Who was older you or me? and where did you born?

A. You were older, I was born at VATUSINEI.

Q. Why didn't you chase Clement Reinunu during his 40 years living at URAHAI?

A. In those days there was no argument between us.

Q. Why did they asked Strack Inuvi and TURAKAEA of Kakau line before building a small school at OGIO which was in your spearline?

A. They looked after the land only they did not owned it, for they were sons of Lakuili lines.

1ST DEF. WITNESS

AMUEL VOGINIA, Sworn States:

Our really village was at KAKAUGA, VANGARUGU was the first person to live there and put our TAMBU Place there PELOPELO and TAVULI KENGE, then came GADOKESA and Tuaniboli, then came GESE and put Tambu place of the EAGLE there, then came VOU, KUA, and MANGANI, then SALE TABARURU, SULUGELU and TASIMARE, then MARISTNA I saw him, he is my brother, the other one was KELIA, the plaintiffs grand father, they lived at MATANAASO, they came down collecting nuts and hunting and fishing at TINA RIVER. They slept two or three days before returning home. In order to carry the nuts they have collected. One day I asked Lelia, why did you often went at Kakauga hunting and collecting nuts, he said, this place is our big place. When we left the TINA River head that's the place where we came and lived. My mother also told me the same story. She also said that HUSAGI to KOLOMATOBA belongs to LAKUILI. There was a cave there too. Where the hunters usually sleep when coning down for hunting, collecting nuts and fishing. KELIA told me the same full story as told by ELIEL TAGOTADA. KIKAVELUSU was CLEMENT REINUNU's grandmother, his mother married one of my brother, Clements mother came from duidui bush. My line or my ancestors only brought Clements ancestors here.

ROKONA came here for safety. He or the Kakau did not own KAKAUGA and its area, it belongs to Lakuili Line.

Q. Where did TSUANI or ROKONA live when he came here?

A. He stayed with ADIKAVI, my father's brother, he ran away before coming here and he was not landowner here.

2ND DEFENDANT WITNESS.

LOVATOGOU, Sworn States:

Four of my fathers took me with my mother when I was a boy. One day we went for buth and take water for drink, and LUSULE told me, from here to the right side belongs to the Kakau Lines, and from here going left belongs to Lakuili line. Once we went to do some gardening and told me that KAKAUGA belongs to you the Lakuili lines, then we came to the Tambu place and said this is tambu place of Pelopelo and Tavulikenge, Loboa, Chale Serele, and Turakaea my fathers told me the same story.

Q. Where were you living when your father told you these stories?

A. KERANA.

Q. Did the Kakau and Lakuili agrees with the spearlines?

A. I didn't know.

3RD DEFENDANT WITNESS.

PASIANGA, Sworn States:

The land argued about belongs to the Lakuili lines. I am from TOUVUSINEI. When I was a small boy, I went with my grandfathers and ancestors for hunting. We came and live at Ngaligaibaru, and when hunting we came to Kakauga and never reached Kerana for that area was owned by the Kakau Line. Two houses at BOGOTOU we planted a bamboo there. Ngaligaibaru and Kakauga belongs to Lakauili. My ancestors told me that this land talking about belongs to us, Lakuili while went hunting with them.

Q. Where did you stay before coming for hunting?

A. TOVUSINEI.

Q. Who was living at Kakauga at these times?

A. Nobody.

4TH DEFENDANT WITNESS.

KIVA KEMUL, Sworn States:

I am of TOVUSINEI. When I was a boy and got a bit older, I follow my ancestors and fathers and mother and my grandmother, and came to TSARIMALENGA and came up to NGALIGAIBARU. We came there to collect the Ngalinuts there. The Ngalinuts of the land we are talking about. Only two of the nuts I can remembered their names, NGALISULISAVUTU and NGALIPAGAMARAO and plenty of them I can't remembered. BABAU told me that I must follow this part, for they belongs to me. BABAU was my grandfather.

Q. Were the nut trees in the area talking about?

A. Yes.

Q. Where did you live before coming to collect these nuts?

A. TOVUSINEI

5TH DEFENDANT WITNESS.

BATU, Sworn States:

My grandfather TABULA and my father VAKANA told me that KAKUGA belongs to Lakuili. Our place we build homes there, the spearline was at Kusage on the left and the right Kolomatoba. VANGARUHU first cut the bushes at Kakauga, then came Gadokesa, Tuaniboli, tambu place of Pelopelo and Tavulikenge there, then came GESE, KUA, VOU and MANGANI, then Sale, TABURU and Sulu those oldmen stayed at this area of Kakauga to Urahai. My father took me there at Karauga, one of my ancestors who stayed at Urahgai. Called me and told me to go and make garden at Kakauga for that part belongs to Lakuili.

Q. Where were some of your above named ancestors buried?

A. I don't know, in those days we do not burry dead people. We just throw them in the bush.

Q. Did any one live at KAKAUGA in those days you are talking about?

A. No. When the old mens named above died, no one live there until today.

6TH DEFENDANT WITNESS.

LAKENA, Sworn States:

My uncle, MOROSAVILIU told me while we were at Kolonatoba, This is the bottom part of Kakauga land. Our land then he pointed out to VASAVOLOVOLO and said that part also belongs to the Lakuili lines. This stories NOELI KABI also was told.

7TH DEFENDANT WITNESS

PEQOA sworn States:

My uncle MANGAPUKU told Matanaaso and came down making his garden there line allowed him before making his garden there to go up to KOITSIGI. My uncle of Lakuili line allowed him before he lives there until today.

8TH DEFENDANT WITNESS.

DONUA, Sworn States:

My two ancestors Tuclamosi and Tugakamiu told me that Kakauga on the hill top and went down to Kolomatoba and at Kusage and went up the hilltop and follow the hill to Saloto kiki and went down to Bogotou. Tabu places there of Pelopelo. Thats all.

9TH DEFENDANT WITNESS.

E. KOEKIBO, Sworn States:

I knew that Kakauga belongs to us of the Lakuili lines. VANGARUFIU cut the bushes there, then came Gadokesa and Tuaniboli and Pelopelo and Tavulikenge their spirit there. Spearlines came down to Kolomatoba and Kusage on the other side. Tambu place of the eagle bird there too. At Urahai, I myself cut the bushes there after the warld war II. Clement married my mother. At that time no any dispute over this small part of land.

Q Why can't you claim this land as yours at that time?

A. In those days we live only as one family and work together.

Q. Did you see any sign as a stone oven there?

A. No.

10TH DEFENDANT WITNESS.

SAMANI Sworn States:

My father only told me that Kakauga and came down to Kolonatoba on the right and Kusage on the left, belongs to the Lakuili lines. Two spirit were put there, Pelopelo and Tavulikenge. I was yet a boy when I followed my father LIONGERE, Peter Brown, AREVUA and Strike and they told me this stories. Thats all I can say.

11TH DEFENDANT WITNESS.

PASIGOLU Sworn States:

Those whom told me that KAKAGA belongs to Lakuili are KAKAU LINE, LOBOA, MATAVATI, SERELE the LAKUILI. SAKA, SORUVUDI and Joe KIRI. The spearline Kolonatoba on the other side and Kusage on the other side, just between two small Rivers. Kolomatoba and Kusage. Lakuili stayed at Lunabogo and Kakau stayed at URAHAI Tambu place of Pelopelo there.

12TH DEFENDANT WITNESS

Mrs Cyrine Sworn States:

I heard from the old woman from Lakuili line, mother of MANGAPUKU. We went ro gather vuvu from the bush at URAHAI, when we came to a stream called Kolotaguliva. She told me that this stream is forbiden for us the Lakuili lines to drink it, only Kraau line can drink it. Because its made of POROTOS TEAR Drops when he was shut up and died in the cave by a Kakau spirit called SASAGA. Then she pointed up to KAKAUGA and said 7 cornshells there, in the Tambu place of Lakuili.

13TH DEF. WITNESS

Mrs MAULI of Kakau Line sworn states:

When I was a girl and lived at KERANA I heard from four olden from Kakau line and Lakuili line they told me that Kakauga and went down to Kolomatoba at the right and went left to Kusage belongs to Lakuili they told me. If you married and have childrens warn them not to work over to Kakauga for that part belongs to Lakuili lines. So those stories I heard made me believe that this part belongs to Lakuili line.

Q. Who stayed with you at that time of the stories?

A. LOBOA and TOBAINULI.

Q. Which lines were they?

A. KAKAU and myself.

Q. Where did they live at that time?

A. KERANA.

14TH DEF. WITNESS

TALAE RESELE, sworn states:

I knew that KAKAUGA are its area as Kolomatoba at the right side and KUSAGE on the left side between the two named Rivers belongs to Lakuili line. Philivakana, Siki TAGOGANA and Paul Tabula told me this story. The post on the ground was Lakuili line. Called the GOROTAVULI and the KAKAU line that stayed with them was KAKAU VATUVULO. This two lines married each other at GOROTAVULI and came to KAKAUGA and out the bushes there. VANGARUGU of Lakuili line out the bushes there. When Vangarugu died GADOKEOA and Tuaniboli came up and a spirit appeared to them in their quarter, called Pelopelo. When they died Pilipili and Tuqaragi. Pipili married KAVEKESA my ancestors. When they died they throw then at Vungatabu at Kakauga with or in the Tamby place of Pelopelo and Tavulikenge. When they died Gese came up and when he died, Vou and Kua Pelugila and Sasala were spirit for hunting and fishing Gese put a tabu place of the eagle bird there too just beside the other Tambu places. That's why I said the Kakauga and its area belongs to Lakuili lines. Rokona did not came to Kakauga, he only stayed at KOITSIGI. Suagoto and Sao were there before he came there. He came at the time where Piri and Tola were head, he stayed under Piri and when Piri died Rokona stayed there and made some big feast.

Feast were not done to do with owning the land but just to share to people what he has got, foods and pigs only. Rokona never came and work at Kakauga, Turakaea lived there follow his father only. That's why he stayed at Lakauga. Turakaea's ancestors married the Lakuili Qorotavuli starting from the beginning. Sale and Kua usually collect the ngalinuts trees there, they were Eliel Tagotada's relatives. Strake and Tobainuli were Kakau line, they started at Lumabogo and came to Inakave and Lusuruka, they did not come and stay at Kakpuga, one of them died there and the other died same where we of Kakau line have no right to say anything about Kakauga. No customary payment or other ways of owning land by custom.

Q. Where there any burrial place there?

A. Yes, at SAGURILOBO.

Q. Who gave Lakuili this part?

JUDGEMENT:

Court having hear of stories of both side, says that she could not see in both stories the custom way of owning lands in the past. No pigs and money was given to any one before using or owning the ground. Both lines claims that the land belongs to them, but could not say why they owned it or what they do before they own this land. Lakuili should have chased the Kakau lines out inside 40 yrs since they lived there.

DECISION:

The Court says that URAHAI Land belongs to the Plaintiff side, Clement Reinunu and his line the Kakau Line. Its up to the plaintiff to call the defendant and do any work together in the land.
