SENTENCE

Mwanesalua, DCJ: The accused in this case has been convicted of rape, contrary to section 137. Indecent assault contrary to section 141 (i) and 145 causing actual bodily harm.

The victim in this case is his wife. They have two children. The offences were committed on 29th March 2015.

The accused has no previous convictions. He pleaded guilty to the count of assault causing actual bodily harm, under section 245 of the Penal Code.

There is delay in his case. That is taken into account before he is sentenced for his crimes.

He was convicted of his offences on 11th of July 2018. He therefore sentenced as follows:

Assault causing actual bodily harm -Two years imprisonment
Indecent assault-Two years imprisonment
Rape -Three years imprisonment

The sentences are to be served concurrently from 17th August 2020.

Order accordingly.
