SENTENCE

The facts of this case are agreed by counsels. The Defendant is Joseph Oloavoze. The Victim is Birana Elizabeth. The Victim and the Defendant were neighbors at Mbokonavera 3 in Honiara in 2016.

In the night of 28th May 2016, the Victim was walking back from a betelnut stall to her house, when she met the Defendant.

The Defendant took the Victim to the boy’s bedroom in the house where he was living at that time. The accused then had sexual intercourse with the Victim in that bedroom. The Defendant was Twenty two years at that time, whilst the Victim was 12 years old.

There were age disparities between Accused and the Victim. It is a very serious offence which carries a sentence of life imprisonment.

There is no report from the prosecution if the accused has previous criminal record. The court will therefore sentence the accused is a first offender.

Joseph Oloavoze will therefore serve a sentence of four years imprisonment for his offence. Order accordingly.
