SENTENCE


Mwanesalua, DCJ: This accused, Silas Saru, has been convicted of Manslaughter on 3rd March 2017. That offence carries a sentence of life imprisonment.


That fact of his case was that he was working for George Wu Company at China on 1st March 2014. On the night of that day a fight occurred outside company’s premises on the road.


The fight was between the accused and the deceased, William Teller. They were both working for that company. Both of them were under the influence liquor on that occasion. At the scene of the fight were two containers for carrying of goods. Electric lights from the houses near that scene eliminated the scene of the fight.


During the fight the accused twisted the deceased’s arm and assaulted him with his knee. The accused held the deceased and pressed him against one of the containers.


The deceased died of cerebral oedema when he was admitted at the National Referral Hospital at 9.15am on 5th March 2014. The cerebral oedema was due to Intracranial Haemorrhages as a consequence of blunt trauma to his head.


The accused has committed a very serious offence. He has no previous convictions. He is sentenced to six years imprisonment. That sentence will begin on the first day when the accused was taken into custody. Order accordingly.
