RULING.
Faukona J: This is an application for bail. The accused was arrested on 3rd of April, 2012 for committing an offence of murder contrary to section 200 of the Penal Code. Since then he was kept in custody.
2. This application premises on the ground that the accused is required to attend his uncle's burial at Kolaridge burial ground. After burial he should return to Rove Prison Service by 4.30 pm. Mr Aupai has pleaded that the accused be granted 3½ hours bail to attend to the burial occasion.
3.Mr Aulangs has not objected to the application and affirm in submission that it is a genuine application. That the accused be bail for 3½ hours to pay his last respect to his late uncle.
4. Both counsels have agreed to bail and to the conditions attach to the bail.
Orders:
1. The accused Manasseh Oso be granted bail for 3½ hours, from 1-4:30pm on today's date. After which he be taken back into custody.
2. (a). He is release on bail in the principle sum of $1,000.00
(b). His sister Cathy Oso to act as surety in the principle amount of $1,000.00.
3. That Prison Service Officers to provide security for the period of bail (3½ hours) until the accused is returned to Rove prison at 4:30 pm.
