RULING ON BAIL APPLICATION
Faukona J: This is an application for bail by the Applicant. The application become necessary after the Applicant was arrested on 20th September 2009, following the death of his wife. Since then he was remanded in custody until this application.
2. The Crown did not object to the application but submits certain conditions be strictly adhered to.
3. Counsel for the Applicant assures the Court that he had discussed the propose conditions with the Applicant who also agrees to abide with all the conditions.
4. Having heard the submissions from both Counsels, and the fact that there is no objection to the application, this court hereby grants the application on the following conditions:
(a) Applicants brother Christopher Tanganiara will stand in as surety in cash bail for the sum of $2,000.00; whilst the second surety Pascal Garo to stand in as principle bail in the sum of one thousand ($1000.00) dollars. And the Applicant be bailed on principle sum of $1000.00.
(b) The Applicant not to reside where all the witnesses reside.
(c) The Applicant not to interfere with Crown witness.
(d) The Applicant to reside with Pascal Garo at Bahai in Honiara, and shall not leave the residence of Pascal Garo from 6 pm to 6 am, seven days a week.
(e) The Applicant to remain in the vicinity of Honiara township and not to travel beyond Lungga and Whiteriver rivers.
(f) The Applicant report to Kukum Police Station every Mondays and Fridays between 8 am and 4 pm.
(g) The Applicant must not release on bail until all the conditions are fulfilled.
(h) The Crown reserve the right to revoke the conditions of bail should the Applicant breached any of them.
