DECISION DISMISSING APPEAL


Cameron P.J.


1. This is an old, stale appeal against sentence which was lodged by the Director of Public Prosecutions as long ago as 23 February 2005 and which has not been diligently pursued.


2. There is no appearance today by the Director of Public Prosecutions despite a notice of hearing having been issued on 10 June 2008 which notice was duly served, and that is typical of the progress of this matter.


3. The respondent served his sentence of imprisonment in 2005, and I am advised by Mr. Nori that he has no other convictions or charges and is, in effect, a reformed man.


4. In all circumstances, the appeal is dismissed.
