JUDGMENT
(Lungole-Awich, J): On the admission of the defendant that he owes the monies which have been due monthly since October 1997, the Court grants judgment to the plaintiff for order of foreclosure. The sums due as arrears and as capital now are due, the charge may now be enforced by sale of the property parcel No. 191-013-78 in Honiara. In view of the plea of the defendant that he would be able to pay up the sums due, I order that the judgment be stayed for 60 days, thereafter the plaintiff may enforce the judgment. This judgment does not stop the plaintiff, if it wishes, from reaching some arrangement with the defendant, but I must emphasise that it does not give right to defendant to insist on settlement with the plaintiff, the right to enforce the judgment has been given to the plaintiff. In the event of execution by sale of the property, it will be by tender to be approved by Court.
Costs of the case including costs of execution is given to the plaintiff.
