JUDGMENT


(LUNGOLE-AWICH, J): The Registrar has made several efforts to have the parties have the appeal relisted after the adjournment of 19.9.1997, some 2 years 7 months ago. He had sent at least 2 letters to the parties before he sent out Notice of today’s hearing. It really is for the appellant to pursue listing of his appeal. I think it is reasonable to assume that appellant received the Registrar’s Notice of Hearing dated 12.2.2000 for today’s hearing. The Respondent received it and he and his solicitor are in Court today ready to proceed with the case.


The appeal is dismissed for the reason that appellant has failed to attend Court and pursue his appeal. Costs of the appeal to the respondent.
