JUDGMENT
(LUNGOLE-AWICH J): On the evidence of adultery against the respondent, and on his admission of the evidence, the Court finds the matrimonial offence of adultery by the respondent with Salome proved, and that the marriage has now broken down irretrievably. The divorce proceeding in 1994 between the petitioner and respondent is disregarded. The proceeding was based on alleged adultery between the present respondent and someone not Salome, the present co-respondent.
The Court grants the petition of the petitioner. It is accordingly ordered that Decree Nisi for dissolution of the marriage solemnised between Silas Livia and Jane Ririko Livia on 16.8.1982 issues. The marriage shall be dissolved after 3 months should no cause be shown for not making the decree nisi absolute.
