BEFORE Justice Albert Palmer sitting in the High Court at Honiara this 11th day of August, 1997.


HAVING heard learned Counsels, Mr Francis Waleilia for the First Appellant, Mr Reginald Teutao for the Second Appellant, Mr Thomas Kama for the Third Appellant, Willie Fioru on behalf of the Fourth Appellant, and the learned Attorney-General for the Respondent,


IT IS ORDERED AS FOLLOWS:


  1. The President of Malaita Province be joined as the Second Respondent.
  2. The President of Malaita Province to file a memorandum of appearance by 26th August, 1997, if he wishes to be heard.
  3. All Appellants to file and serve on the Respondent within 14 days thereafter, a list of documents to be relied on in the appeal, but without prejudice to any further applications in respect of any other relevant document that may be discovered thereafter.
  4. Request for copies of any documents discovered to be produced within 7 days thereafter.
  5. The Land Acquisition Officer, Mr David Totorea to file a copy of the map used in the acquisition proceedings by 9th September, 1997.
  6. Hearing date fixed for 22nd September, 1997 at 9.30 am. Time estimate 1 week.
  7. Liberty to apply on two (2) days notice.
  8. Costs in the cause.
