WARD CJ: This is an appeal purporting to be against conviction but is simply against sentence.


The appellant raised two matters not raised in the lower court.


  1. He alleges assaults on him by the police. These have not been raised before and there is no way to substantiate them and I cannot rule on these now. However, I note he does not deny the offence despite the allegation.
  2. He had paid compensation to the parents of the victim before it was reported to the police. This was not raised at the trial but I note he had no lawyer. I feel that is a matter that may have reduced the sentence but I do not feel it would have reduced the sentence for an offence as serious as this beyond a very small amount. This court will not interfere in those circumstances.

Appeal dismissed.
