JUDGEMENT OF THE COURT

  1. We order that you will file an application for re-call of the final Court of Appeal decision along with a supporting Sworn Statement by the end of November 2023.
  2. We order that you are granted leave to serve by way of substituted service by a single publication in the Solomon Star within 14 days of filing the re-call application.
  3. We direct that this matter be set down for the re-call application case to be heard at 9.30am on the second day of the next sitting of the Solomon Islands Court of Appeal.
  4. No order for costs.
  5. We Grant leave to the Whitlam K Togamae Lawyers to withdraw as representing the Appellants in this matter.
  6. We direct the Registrar to hold a direction’ conference immediately on the Court resuming its business in 2024, so she can set down directions regarding the filling of submissions and other matters.
