JUDGEMENT - CONNOLLY P.
When this appeal was called on for hearing I drew attention to s. 6 of the Court of Appeal Act and stated that owing to the absence on leave of Palmer J. and the fact that the appeal was from the Chief Justice and only two Justices of Appeal were available in Solomon Islands it was not practicable for a Court of Appeal of three to be convened and that the Court was therefore duly constituted by Williams J.A. and myself. Neither party sought an adjournment.
I have had the advantage of reading the judgement prepared by Williams J.A. I agree in his Lordships's reasons and in the order which he proposes in the last paragraph of his judgment. That order will therefore be the order of the Court. The appellant must pay the costs of the hearing before the Court of Appeal on 18 June 1993 to be taxed.
