AGREEMENT BETWEEN THE GOVERNMENT OF THE UNITED STATES AND THE GOVERNMENT OF THE REPUBLIC OF THE MARSHALL ISLANDS REGARDING AUGMENTATION OF EDUCATIONAL ASSISTANCE CONCLUDED PURSUANT TO SECTION 224 OF THE COMPACT OF FREE ASSOCIATION

ENTRY INTO FORCE: 7 SEPTEMBER 1988
PREAMBLE
The Government of the United States and the Government of the Republic of the Marshall Islands:
RECOGNIZING that the Compact of Free Association, signed by the Government of the United States and the Government of the Republic of the Marshall Islands on June 25, 1983 (the Compact), became effective on October 21, 1986; and
REAFFIRMING the common interest of the United States and the Republic of the Marshall Islands in maintaining a close and mutually beneficial relationship through a free and voluntary association of their Governments;
DESIRING to promote the objectives embodied in the Compact by augmenting the educational assistance provided under Section 216, Section 221, Section 223 and other provisions of the Compact, as well as Section 103(h) of United States Public Law 99-239;
RECOGNIZING that United States educational assistance to the Republic of the Marshall Islands in addition to that provided pursuant to Section 216(a)(3) of the Compact has been authorized by United States Public Law 100-369;
RECOGNIZING that the purpose of such additional educational assistance is to restore levels of assistance for post-secondary students from the Marshall Islands comparable to those which were available prior to entry into force of the Compact;
NOW, THEREFORE, AGREE, in accordance with Section 224 of the Compact, as follows:
1. The Pell Grant Program, Supplemental Educational Opportunity Grant Program and College Work Study Program as authorized by title IV of the United States Higher Education Act of 1965 shall be extended to students who are citizens of the Republic of the Marshall Islands and who attend post-secondary institutions in the United States, its territories and commonwealths, the Trust Territory of the Pacific Islands, the Federated States of Micronesia or the Republic of the Marshall Islands.
2. The assistance to be provided in accordance with paragraph 1 shall not be available to students from the Republic of the Marshall Islands receiving assistance pursuant to Section 223 of the Compact.
3. The Government of the Marshall Islands shall use its best efforts to assure that the curricular choices made by citizens of the Marshall Islands availing themselves of United States post-secondary education assistance will support the manpower development objectives set forth in the National Development Plan of the Republic of the Marshall Islands.
4. The Government of the United States and the Government of the Republic of the Marshall Islands shall consult as appropriate and exchange information with respect to the administration of educational assistance in accordance with this Agreement.
