AN ACT

entitled

University of Vudal (Amendment) Act 2009,

Being an Act to amend the University of Vudal Act 1997,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with and in accordance with, the advice of the Minister.

1. AMENDMENT TO THE SHORT TITLE.

The short title of the Principal Act is repealed and is replaced with the following –

"Papua New Guinea University of Natural Resources and Environment Act 1997.".

2. AMENDMENT TO THE LONG TITLE.

The long title of the Principal Act is repealed and replaced with the following –

"Being an Act to provide for the establishment and incorporation of a University to be known as the Papua New Guinea University of Natural Resources and Environment and for related purposes.".

3. INTERPRETATION (AMENDMENT TO SECTION 2).

(1) Section 2 of the Principal Act is amended by repealing the definition of "the University" and replacing it with the following –

"the University" means the Papua New Guinea University of Natural Resources and Environment.".

(2) Wherever, either in the Principal Act, Statutes, by-laws or rules, the words "University of Vudal" or "Vudal University" or similar expression appears, that reference is a reference to the "Papua New Guinea University of Natural Resources and Environment".

4. ESTABLISHMENT AND INCORPORATION OF THE UNIVERSITY (AMENDMENT OF SECTION 3).

Section 3 of the Principal Act is amended –

(a) by repealing Subsection (1) and replacing it with the following –

"(1) The Papua New Guinea University of Natural Resources and Environment is hereby established."; and

(b) in Subsection (2), by repealing the words "The University of Vudal" and replacing them with the following –

"Papua New Guinea University of Natural Resources and Environment.".

5. NEW SECTION 3A.

The Principal Act is amended by inserting a new section immediately after Section 3 as follows –

"3A. ESTABLISHMENT OF OTHER CAMPUSES AND OFFICES.

The University may establish campuses and offices anywhere in Papua New Guinea or overseas for the expansion of its teaching and research purposes.".

6. OBJECTS OF THE UNIVERSITY (AMENDMENT OF SECTION 5).

Section 5 of the Principal Act is amended by inserting after Subsection (2) the following new subsection –

"(3) The primary role of the University is to provide education and training that deals with the sound management of the natural resources and environment of Papua New Guinea and for related purposes.".

7. THE COUNCIL (AMENDMENT OF SECTION 9).

Section 9 of the Principal Act is repealed and replaced with the following –

"(1) There is established a Council which shall consist of –

(a) the Chancellor who shall be the Chairperson; and

(b) the Pro Chancellor; and

(c) the Vice Chancellor; and

(d) the Pro Vice Chancellors; and

(e) one Vice Chancellor from another University appointed by the Council; and

(f) the Chairperson of the Commission of Higher Education or a nominee,

who shall be ex officio members; and

(g) one Dean elected by the Academic Board; and

(h) two graduates, one of whom shall be a female, not being employees or currently registered students of the University appointed by the Council; and

(i) two members of the community appointed by the Council.

(2) Where, at any meeting of the Council, an agenda concerns any specific affairs of an external body that is not represented on the Council, the Council may co-opt a member of the body to attend that specific meeting of the Council for that agenda only.

(3) A member co-opted under Subsection (2) shall not be counted towards the quorum and has no voting rights.".
