AN ACT

entitled

Survey (Amendment) Act 2022,

Being an Act to amend the Survey Act 1969 and for related purposes,

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting on the advice of the Minister.

1. INTERPRETATION (AMENDMENT OF SECTION 1).

Section 1 of the Principal Act is amended -

(a) by inserting "(1)" before the words "In this Act,"; and
(b) by repealing the definition of "authorized survey" and replacing it with the following:

• ""authorised survey" means a survey of land or buildings authorised or required -
  • (a) by, under or for the purpose of any law; or
  • (b) by the Government; or
  • (c) by the owner, lessee, mortgagee or other person having an interest in the land or buildings,
• and in the case of a certified measurer means a Rural Class 3 Survey;"; and

(c) by inserting a new subsection, after the definition of "urban lands", as follows:

• "(2) Where, in this Act, a reference is made to land surveys, that reference shall be read as a reference to buildings under the strata title schemes.".

2. SURVEYOR GENERAL (AMENDMENT OF SECTION 4).

Section 4 of the Principal Act is amended by inserting a new subsection after Subsection (2) as follows:

"(3) The Surveyor General must create a registry within the Central Plan Office established under Section 8 of the Survey Coordination Act 1967 for the deposition of survey plans for land and buildings where strata development leases are to be registered and kept.".
