ARRANGEMENT OF SECTION.

New Section 196.

"196. 2020 AMENDMENT ACT NOT APPLICABLE TO P'NYANG LNG PROJECT.".

AN ACT

entitled

Oil and Gas (P'nyang LNG Project) (Amendment) Act 2021,

Being an Act to amend the Oil and Gas Act 1998,

MADE by the National Parliament.

NEW SECTION 196.

The Principal Act is amended by adding immediately after Section 195, the following new section:

"196. 2020 AMENDMENT ACT NOT APPLICABLE TO P'NYANG LNG PROJECT.
(1) In this section -

• "P'nyang Field" means the petroleum accumulation known as the P'nyang Field contained within the licence area of petroleum retention licence number 3.

(2) Notwithstanding any other provision of this Act or any provision of the Oil and Gas (Amendment) Act 2020 (No. 11 of 202) (the "2020 Amendment Act") -

• (a) each of Section 54, Section 56 and Section 57 of this Act, as in force immediately before the 2020 Amendment Act came into effect and subject to Section 184 and Section 185 as continued in force by Paragraph (c), shall apply to and in respect of any application for a petroleum development licence number 13 made pursuant to Section 53 of this Act on 6 February 2015; and
• (b) each of Section 54, Section 56 and Section 57 of this Act, as amended by the 2020 Amendment Act, and each of Section 56A, Section 56B, Section 56C, Section 57A, Section 57B, Section 192, Section 193 and Section 194, shall not apply to or in respect of the application for petroleum development licence number 13 made pursuant to Section 53 of this Act on 6 February 2015; and
• (c) each of Section 184 and Section 185 of this Act, as in force immediately before the 2020 Amendment Act came into effect, shall apply to and respect of a gas agreement in respect of a gas project having the purpose of recovering natural gas and other petroleum which is incidental to the recovery of natural gas, from the P'nyang Field and shall continue to so apply as if the 2020 Amendment Act had not come into effect at all; and
• (d) each of Section 184 and Section 185 of this Act, as amended by the 2020 Amendment Act, shall not apply to or in respect of a gas agreement in respect of a gas project having the purpose of recovering natural gas and other petroleum which is incidental to the recovery of natural gas, from the P'nyang Field.".
