AN ACT
entitled
Local Courts (Repeal) Act 2000,
Being an Act to repeal the Local Courts Act (Chapter 41), and for related purposes,
MADE by the National Parliament.
The following Acts are repealed:-
(a) Local Courts Act (Chapter 41)
(b) Local Courts (Amendment) Act 1986 (No. 13 of 1986)
(c) Local Courts (Restriction of Movement) Act 1986 (No. 25 of 1986).
All proceedings commenced in a Local Court and not completed immediately prior to the coming into operation of this Act are, on that coming into operation, deemed to have been transferred to the District Court and so much of the procedure relative to such proceedings which has been completed on the Local Court is deemed to be the equivalent procedure completed in the District Court.
(1) All orders made by a Local Court under the Acts repealed by Section 1, insofar as still in force and not fully implemented immediately before the coming into operation of this Act, continue in force after that coming into operation as if they were orders of a District Court made under an equivalent provision in the District Courts Act (Chapter 40) and any further procedure necessary in respect of such orders shall be the appropriate procedure under the District Courts Act (Chapter 40).
(2) All penalties imposed by a Local Court under the Acts repealed by Section 1, insofar as not implemented or enforced immediately prior to the coming into operation of this Act, continue, after that coming into operation, to be enforceable under the District Courts Act (Chapter 40) as if they were penalties imposed by a District Court.
Any right of appeal froth a decision of a Local Court under the Acts repealed by Section 1 subsisting immediately before the coming into operation of this Act, shall, after that coining into operation, be treated as a right of appeal from a decision of a District Court under the District Courts Act (Chapter 40).
