AN ACT

entitled

Fire Service (Amendment) Bill 2005,

Being an Act to amend the Fire Service Act (Chapter 64),

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

POWERS OF THE CHIEF FIRE OFFICER (AMENDMENT OF SECTION 17).

Section 17 of the Principal Act is amended -

(a) in Subsection (5) by repealing the penalty and replacing it with the following:–

"Penalty: Where the person convicted of an offence is -

(a) a commercial enterprise — a fine not exceeding K50,000.00; and

(b) other than a commercial enterprise — a fine not exceeding K10,000.00 or imprisonment for a term not exceeding 2 years."; and

(b) in Subsection (6) by repealing the penalty and replacing it with the following:–

"Penalty: Where the person convicted of an offence is:–

(a) a commercial enterprise — a fine not exceeding K50,000.00 and in addition, a fine not exceeding K5,000.00 for every day the offence continues; and

(b) other than a commercial enterprise — a fine not exceeding K10,000.00 or imprisonment for a term not exceeding 2 years and in addition, a fine not exceeding K500.00 for every day the offence continues,".
