AN ACT

entitled

Conservation and Environment Protection Authority (Amendment) Act 2019,

Being an Act to amend the Conservation and Environment Protection Authority Act 2014
and for related purposes,

MADE by the National Parliament to come into operation in accordance with a notice in the

National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

ENVIRONMENT MANAGEMENT FEES (AMENDMENT OF SECTION 33).
Section 33 of the Principal Act is amended by repealing and replacing Subsection (1) with the following new subsection:

“(1) A person who -

(a) is the holder of or applicant for an environment permit under the Environment Act 2000; or

(b) is the holder of the Ok Tedi Permit issued under Section 13 of the Ok Tedi Environment Management Act 2018; or

(c) has carried out, is carrying out or is proposing to carry out an activity within the meaning of the Environment Act 2000 -

(i) which has resulted, is resulting or is likely to result in a change to the environment; or

(ii) which has caused, is causing or is likely to cause environmental harm within the meaning of the Environment Act 2000,
shall pay an environment management fee in respect of that environment permit,
Ok Tedi Permit or application or the carrying out or proposed carrying out of that
environment permit or application or the carrying out or proposed carrying out of
that activity, irrespective of whether or not that person holds or is required to hold
an environment permit.
