AN ACT

entitled

Arrest (Amendment) Act 2000,

Being an Act to amend the Arrest Act (Chapter 339),

MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

1. COMPLIANCE WITH CONSTITUTIONAL REQUIREMENTS.

This Act, to the extent that it regulates or restricts a right or freedom referred to in Subdivision III.3.C (qualified rights) of the Constitution, namely, the right to freedom of movement conferred by Section 52 of the Constitution, is a law that is made for the purpose of giving effect to the public interest in public safety and public order.

2. APPLICATION (AMENDMENT OF SECTION 2).

Section 2 of the Principal Act is amended:-

(a) by inserting the following parentheses at number "(1)" before the word "Notwithstanding"; and
(b) in Subsection (1), by repealing the words and figures "but subject to Section 24" and replacing them with the following:-

• "but subject to Subsection (2) and to Section 24"; and

(c) by adding the following new subsection:-

• "(2) This Act does not apply to an arrest made under the Civil Aviation Act 2000.".
