Woo Chin Fook v Richardson [1957] PGSC 9 (1 January 1957)

IN THE SUPREME COURT OF THE
TERRITORY OF PAPUA AND NEW GUINEA

Appeals No. 16 of 1957

The District Courts Ordinance
1924-1956 of the Territory of New Guinea.

WOO CHIN FOOK
Appellant

against

M.J. RICHARDSON
Respondent

JUDGMENT

In this case I have carefully examined the evidence and further evidence and in my view there is ample to support the Learned Magistrate's judgment, with which I agree.

I can see no sufficient reason to deprive the Plaintiff of her costs.

I therefore dismiss the appeal with costs to be taxed or agreed upon by the parties to the appeal or should the parties desire it the Appeal Court will fix the costs of and incidental to the unsuccessful appeal.

(sgd.) E.B. BIGNOLD
J.
