Cabinet makes the following Regulations under Section 36(2)(c) of the Maritime Security Act 2019:
- Citation
These Regulations may be cited as the Maritime Security (Prohibition) Regulations 2020.
- Commencement
These Regulations come into effect on the day they are notified in the Gazette.
- Approaching or boarding ship without lawful authority
- (1) A person without the prior authorisation from customs, immigration, quarantine and the consent of the Harbourmaster shall not:
- (a) approach or board any ship in Nauru waters;
- (b) take or cause another person to take any material onto a ship in Nauru waters; or
- (c) remove or cause another person to remove any material from a ship in Nauru waters.
- (2) No person shall aid or abet any person to contravene subregulation (1).
- (3) A person who contravenes subregulation (1) or (2) commits an offence and upon conviction is liable to a fine not exceeding $10,000
or to a term of imprisonment not exceeding 6 months or to both.
